Tax Credit complaint does it ever work ?

Hi all,

Just a query really after going round in circles with Tax credits and countless phonecalls and letters where they keep telling me i have"nt notified of my circumstances changing and i have countless times i have decided to lodge a complaint :mad: .

I have spoken to a complience officer more than once got absolutly nowhere her attitude is they dont make mistakes oh and she said it will take a long time to sort hmm perfect then :rotfl: so after two months of hassle and no tax credit payments which we are legally entitled i have written a letter of complaint.

What i was wondering is do this ever work do they ever admit they are at fault the compliance officer was pretty adamant they never are would like this sorted before our new baby arrives next month or is this living in too much hope :eek: .

    There are frequently times when such cases are long and very very drawn out and you can't take it further until you've got an unsatisfactory response to your complaint.

    you can find out from HMRC website the formal process for complaints.

    I'd report it to your MP

  • I am in a nightmare situation with them too and there is a procedure to follow. I found this website a huge help:

    It details exactly what to do step by step.

    I am in the process of a formal complaint and have now received all of my paper records which highlights their errors. I am not waiting for a copy of all my telephone calls. Where I have been fortunate though is that I always record the time, date and name of the operator when I call them! This is really, really important.

    My formal complaint has been on going for about 4 years. :eek:

    I have followed their codes of practice to the letter and every now and again I just receive another threatening letter demanding my so called overpayment.

    The last time I received one of these letters was about 6 months ago and I had got to the point where I couldn't be bothered to argue the point any longer so telephoned them to make the payment and get them off my back.

    The debt collection department said they couldn't take my money as my case was supsended and I was to just wait for them to write to me again once they had looked at it again. :confused:

    I haven't heard anything again since. This doesn't surprise me though as it took them 2 years to respond to my first letter. I would therefore assume there is a chance your baby could be gradutating university before your complaint is resolved.

  • My understanding is that they cannot take you to court or keep sending bailiffs round if you are officially "in dispute" with them.

    But I am not at this stage, though mine too has been going on for over 4 years.

    The HMRC have already admitted errors on my case (which I have in writing!). Now I have found more and it seems to boil down to their (crap) computer system.

    Scenario:

    I ring them one day to tell them a change of circumstance.

    The next day - the data has miraculously dissapeared from their system!

    Though when I get a copy of my records, the fact that I called and an overview of the reason for my call is there in black and white!!! :mad:

    Stick with it!!!!!!!

    Thanks for your replies really appreciate it you did make me chuckle Spinks new bubs prob will graduate before they manage to sort it :rotfl: That a good idea Suelees1 to report it to my local MP i know he does days when you can go and see him locally be worth a visit ;)
    Thanks for that link to site Welshnoonoo :A been and had a look it is a brillant site lot of imformation i can use your situation sounds just like mine lost information you ring you write and tell them yet they somehow manage to lose it and cant they be obnoxious when you point this out wonderful people skills :eek: .

  • It is such a relief to know its not just me who's having a nightmare with them! I have an ongoing dispute which has lasted 3 years. I am not going to lose sleep over it, as I know I don't owe them anything and I have filled in every scrap of paperwork on the planet that is required. They keep threatening to take me to court. To be honest, I wish they would, then maybe it would be over and done with!

    It is a total nightmare is"nt it :mad: i"m lucky to the extent that mine has only been going on for 2mths my problem is they keep saying they cant find my husbands details even thought i have verbally told them and written so they are insistant i only claimed in my name makes me so furious he signed form aswell as me yet they cant find record :mad:

    They wanted mortgage statements the lot i told them to take hike on that one :rotfl: it not my mistake its theirs and i will continue to fight it :D .

    It stress we could all do without good luck with your case when you read other peoples stories it makes you realise how bullying they can actually be :mad:

  • They keep threatening to take me to court.

    There is a form you can download either off the HMRC website or the www.taxcc.org website. It's a dispute form and as soon as you are "in dispute" they are not allowed to take you to court. (Disclaimer: I am no lawyer just a Mum who has been shafted by the HMRC so you must get a second opinion!!! :D )
