22.12 If you reject an appeal you must:

Non-compliance with the Code will be dealt with and
monitored through a scheme of sanctions. We will
issue sanction points depending on the severity of the
non-compliance. If you reach twelve points on your
!!!8216;membership licence!!!8217; in any twelve month period, we may
refer you to the BPA Council for disciplinary action. The
referral may result in your membership with the AOS and
the BPA being suspended or terminated.

If we find there has been a failure to comply with the
Code, either during a complaint investigation or a
compliance audit, you must make appropriate changes to
your business operation to bring it into compliance. We
will write to you asking for the changes to be made. This
will be a formal request and we will give you a timescale
for you to make the changes and send us evidence that
you have done this. Depending on the nature and severity
of the alleged Code breach, we may issue suspended
Sanction Points and/or a formal letter of censure


however in the case of indigo , they spout this

I can see that in this instance, the charge was issued for a breach of the advertised terms and conditions by on privately owned Railway land. Charges issued on Railway land are referred to as Penalty Charge Notices because they will have been issued under railway Byelaws as well. Whilst I am sorry to learn if you were unhappy with the outcome of the appeal, it is not something I can address. The BPA has no authority to intervene in the appeals process.

As the charge has been issued on railway land, then please be be advised that the BPA has temporarily removed the requirement for our members to provide a POPLA verification Code when an appeal is rejected. This is due to complaints being made that POPLA are not able to oversee appeals made where railway Byelaws are concerned. Until a solution is found, if a motorist remains unhappy following an appeal!!!8217;s rejection, they can appeal further via a Magistrates Court; our Code from which you have quoted does not reflect this at the moment as the decision is temporary. Unfortunately, as we cannot advise you how long the requirement will remain lifted, you will now need to use the Magistrate!!!8217;s Court to appeal further.

The British Parking Association (BPA) has campaigned at length for clarity on the clauses in Railway Byelaws pertaining to parking to be improved, and the Government committed at a meeting in January to provide clarification but due to various circumstances, some beyond their control, this has not been forthcoming. In the meantime we will continue to work with Government to achieve a resolution to Railway Byelaws Clauses.

Please also be aware that when a charge remains unpaid, then in due course it will be escalated to debt recovery. This is standard procedure. The cost of the charge can increase as the debt collection agency add on their costs. With that in mind, I would suggest that you now either pay the charges, or seek legal advice to contest it via Magistrates court.

why was the code of practice not updated to state this ??

indigo should be removed from DVLA on any railway/bylaw sites from access asd they are not complying with the code of practice

    I thought INGIGO couldn't/weren't getting keeper details for railway/bylaws sites at present and that is why the Newbies Sticky has been amended to say not to appeal a windscreen ticket at day 26 so as not to give your details away? Or have things moved on?

    we have got proof that indigo ARE getting info via DRP and stating bylaws as reason , as new as last week

    "An update on this: the KADOE volumes for the last quarter of 2017 have just been published on line. Indigo made 3653 requests in Oct/Nov/Dec, of which 877 were in December.

    the statement "from the DVLA

    ""Indigo Parking have advised that they are not and have not for a number of months been requesting data whilst they are investigating this matter" . " was in january , and clearly says "several mths" whereas the KADOE volumes disprove this

    Remember that Indigo infest hospitals and lots and lots of other nasty cash-cow hotspots that can account for plenty of those KADOE requests. They are getting data for other car parks.

    yes , but is that the same indigo?

    even if it was the same , I dout DVLA would do any checking , and we have seen sight of one (dvla printout) jan 2018 using DR+ , so indeed indigo may not be getting bylaw info , just leaving it to DR+

    It's Indigo Park Solutions Ltd (previously known as Meteor) who made those data requests. As far as I know they only do railway stations.
    Indigo Park Services, who infest hospitals as well as quite a few local authorities, are listed in the KADOE volumes separately
