Cat6 CIFAS Marker and current debts.

Hi There,

First post on the forum and i was looking to gain some advice on the following:

It's very likely that the Bank of Scotland are going to be placing a Cat6 CIFAS marker on my account for questioning 2 transactions that i didn't make.

Now if they do this, am i right in thinking that all current credit will be stopped and all future options are out the window for six years?

If the above is true, and i know this isn't the best attitude to have, but is there seriously any point in me paying back the loan / CC i have with BOS?

I have looked and it's pretty much near impossible to get the marker removed once placed and if i have no ability to have a bank account are they expecting me to make 24 monthly trips to one of their branches to pay off the credit card and loan in cash?

Anyways, any feedback or input would be very much welcomed. Completely drained and over worried about the future implications of this likely marker.

    No. I asked them to check out two transactions and send out a new card for safety.

    A day later they closed my account due to "misuse of account" and sent out a very vague letter saying i had 60 days to get a new account.

    It wasn't until 4 days later on Saturday that after hours of pressing i was told that they believe i am being fraudulent in my claims. I didn't claim anything other than i wanted them to check the transactions as i didn't make them. It was to a gambling website i am a member of.

    Within this conversation i asked about CIFAS as i did some research through the week.

    The advisor basically said a marker would be put in after they here back from the casino because the BOS have made their minds before getting all the facts.

    It's particularly frustrating as i have three other advisors recorded before this calk saying it was nothing to do with fraud.

    I think it's safe to say i am screwed for six years?

    Aside from the bank (eventually) making you bankrupt?

    Rather than defaulting, a better idea might be to see whether a credit union will let you open a current account with them - you might be lucky. If so you've found an alternative, though you may well have a monthly charge to run your account for the next six years.

    I have been looking at alternatives like credit unions and cash cards like monese etc. I don't mind paying a fee but the online accounts seem to run into a lot of problems.

    I think i am just angry at how trigger happy the Lloyds group are with these CIFAS markers. (I've read hundreds of posts this week). And with this anger i am like "six year marker, let the loan default and it's cleared in six years"

    I know it's a poor attitude. But it feels like the only round about compensation from all the inaccurate information and stress this has caused me.

    Very lucky i can pay wages into my partners account. Only saving grace out of all this.

    It’s very rare for lenders to apply to make someone else bankrupt. It’s rare for DCA’s too.

    It’s only the taxman who has a habit of doing this.

    Much more likely is a CCJ, followed by bailiffs or an attachment order. Or, if they own a property, a charging order.

    Either way their history will be trashed for longer than the marker is on it.

    Why do you think that the bank will not go to court? No matter how much someone had annoyed me, I can!!!8217;t see that I!!!8217;d Welch on a debt to them.

    I live in Scotland and generally the debt needs to be 5 grand or more to get near a court.

    It isn't a big loan at all. It's the principal that they've done me for six years with no real evidence to support there claims.

    Would you be friends with someone that called you a fraudster?

    No, but taking the friend off your Christmas card list is different to running away with their money.

    You seem to be jumping the gun. Focus on avoiding the marker. Get your evidence together that the transactions were fraudulent. Then engage their complaints process and ultimately take it to the ombudsman if you are convinced your argument stacks up.

    Just wanted to say thank you for all the feedback. I am currently half way through the 45 day charge back and my bank have assured me that i have nothing to worry about as i have done nothing wrong.

    My accounts were closed due to heavy gambling activity but hopefully i won't need to worry about a CIFAS marker after the charge back is settled.
