war pention

I receive a war pension and have been in an iva for 4 years now. The company that runs the IVA have told me that my war pension counts as an income I also get unemployability as I can no longer work and a military pension. I have read that my war pension should not be taken into account as this is awarded for the suffering that I endure every day as a result of the injury that was sustained in the armed forces. Has anyone any ideas

    In bankruptcy, a War Disability Pension counts as a state benefit. The OR is not supposed to ask for a contribution from someone whose only income is state benefits, but they will include state benefits income if their are other sources of income.

    I assume it's the same with an IVA. But I don't know for certain.

    I'd guess that a "military pension" is not a state benefit, so therefore the "company that runs the IVA" would be correct in including both the war pension and the 'unemployability' benefit.(JSA, ESA, UC, whatever.)

    I think the logic is that it is all about calculating your disposable income. If all you get is state benefits, your disposable income should be zero. But if you get other income as well it might not be zero, so they have to include state benefits to work out what it is.
