Roofing work issues

Hi!
Ok, so basically we put an ad on mybuilder.com for some roofing works, had a guy come and give us a quote, saying it just needed a few tiles replacing, chimney re-pointing and new guttering, he quoted us £1000.00 + VAT, so we asked if he'd do is cash without vat and we agreed the £1000.00 cash.
He came and did the works when he said, and all semt ok ...
Then came the rain ....
Basically it's leaking between the guttering and the roof, so we've rang him up and he's said "oh, yeah it's cos there was no felt there" (which he would have known before he put the new guttering up!) ... We asked why he didn't inform us of this, cos without the felt the gutter is pretty useless, but he said cos WE JUST ASKED HIM to repair the tiles, re-point the chimney and replace the guttering it was basically tough ... But he would give us another quote to do the felt ....
Where do we stand? Is there anything we can do?
Any advice would be greatly appreciated
Thanks, Anna & Mark

What can you do? Chalk it up to experience, get someone to do the necessary remedial work and pay any VAT due on that job (if it's charged by the builder) to make sure it's all above board. It is probably an expensive lesson because I suspect the remedial work is going to cost more than the £200 you thought you'd saved.0 -
I can comment only on what you post and you may not warm to my views. You have been naive and foolish to get into this situation and there is little you can do about matters. The obvious solution is to get a competent roofer to sort out your problems having first had a proper analysis of what issues exist with your roof. A professional opinion should be considered here first.
Briefly consider this. You were given a quote+VAT. This was nonsense stage one. You are a retail customer and prices include VAT. (Do Tesco quote you bottles of wine at £6+VAT? Of course not) Second the figure pre VAT was a magical round figure of exactly £1000 - which sends out obvious signals. Third you colluded to evade VAT (illegal behaviour, and signing away your rights.) Fourth I suspect you did no due diligence and no checks on the roofer (but over to you here). Fifth your actions sent signals to the roofer that you were were a push over waiting to be conned. Sixth there was clearly no Specification written by you after first undertaking a thorough investigation done by you (lack of roofing felt is a blindly obvious problem to spot). Seventh, had you managed and inspected the works you would have picked up all issues prior to paying the roofer (you would then not be in this situation)
Now for the elephant in the room. It is a requirement for all roof tiles and slates to overhang guttering at least to the half way line of the gutter. This means the issue of no roofing felt becomes a red herring in most situations. In turn this probably means your roof covering is wrong and this has nothing to do with the lack of felt. Or your guttering is set out incorrectly for height, spacing and falls.
Now back to fundamentals and start again - this is why you need a competent analysis of your issues. Now stage two - there is a likelihood everything done by your roofer has been bodged and needs doing again.0
