hi folks, anyone heard of the misspelling of the points system club la costa is running, and companies offering no win no fee, to claim back your money on the mis-selling of them, listing high court wins in madrid, as contracts are now null and void due to them mis selling them, and anyone heard of mercantile, can't find anything on them as in reviews, are they real or another scam company, have offered to deal with my purchase with club la costa

    You are quite right concerning the illegality of Timeshare/Holiday Clubs that were sold in Spain and the Canary Islands, lots of Companies have cropped up, some scams and some genuine Companies, they contacting Javier at this Website: http://www.correaguimera.com.

    The company was only incorporated on 10/10/2016 so less than 1 year old.
    If you go down to the woods today you better not go alone.

    If they called you, it is almost certainly a scam. If you called them, perhaps less so. As noted they have only been in business since November so it would be unlikely they would have any satisfied customers so far.

    The terms and conditions on the website are very simple and suggest they take (an unstated) percentage of any recovery but make no mention of any up front fees. The minute anyone suggests you pay to get rid of it or worse buy something else instead with a promise of a cash back at some point in the future, run as fast as you can.

    This company have a good track record of timeshare terminations. Importantly they do not charge any up front fee for their service which is normally a good indication of the type of company they are. They have some decent testimonials online mercantileclaims.com/testimonials

    They are the sister firm to Praetorian Legal (praetorianlegal.com) who are registered and authorised with the MOJ (Ministry of Justice) another important factor to take into consideration when dealing with claims companies.

    We're trying firm called Alpine Assessors to get compensation for misselling by Club La Costa ppint-based timeshare. They claim high success rate. No win no fee. BUT £4,450 upfront - they say this is refunded if they don't get a result in 2 years. Are we throwing good money after bad?

    Yes, you certainly are. Paying up front is not no win no fee. Never ever pay a penny up front. This company has a share capital of £1, was formed last year and has filed no accounts at Companies House.

    Their website claims 10 years experience, quite how the company can claim that when it was formed in February last year is difficult to see but if they will lie on their website, why would you offer them a penny?

    The sole director is Sean Patrick Howes who was previously a director of Luxury Matters Ltd which was struck off in 2016 having never filed accounts either, do you see a pattern?

    We have experienced awful customer service in trying to exit our fractional timeshare with CLC. Being batted back and forth with the finance company and struggling with the payments we finally got cornered by CLC into surrendering our membership just before the recent court ruling and since discovering that fractional contracts were illegal - period - and on the spot finance agreements also illegal - period. Both of which we discovered just now. Other discoveries that have left us seething. Is there anyway of dealing with this and getting our money back without solicitors?

    We are just back from Tenerife where we were subjected to a 6 hour grueling presentation by one such NO-WIN-NO-FEE company.

    At the end of the long day, they make you sign a lot of paperwork, put £7500 on your credit card and tell you to expect £15000 in your account of which they will send you an invoice for another £7500.

    With me so far?

    In the paperwork, there is no mention of your claim, claim amount, signature from a director or anything else useful for which you travel down to them in the first place.

    First advise - hang up.
    Second advise - don't go anywhere. They want you there so they can sell to you. They will say that by registering a claim in Tenerife or elsewhere, it won't be subject to capital gains tax. When is a claim subject to CGT?
    Third advise - If you do go and listen to a presentation - insist on paperwork supporting your claim and not for purchase of some random holidays.
