    1. What would you do given this situation? Check the facts

    2. If they make Small Claim, what are my chances of winning? 100% if the facts are in your favour

    3. What is a good defence against Court Claim? The facts

    4. Does CCJ have negative effect on credit rating? Yes, especially if you are stupid enough to get one by losing, and failing to pay in 28 days.

    PS Did I mention that the issue will turn on the facts such as the signs that were there and pics of your car in relation to these. Apparently you've been sent them but we can only guess what they say/look like as you haven't shared anything with us.

    Thanks for the reply, facts are as follows:
    The pictures show the car is stopped on verge/footpath, facing away from Gate towards exit,
    looks like hazard lights are on.

    There is close-up picture of the car windscreen, it clearly shows there is no driver in the car.
    Also there is 1 Napier Parking Sign next to the Gate, small writing and not easy to read.

    Looking at the Close-Up Picture of Windscreen, I don't like the fact there is no driver in car.
    Do I have any Defense, or should I pay?

    A ccj only has a negative effect on your status if you ignore it for more than a month.

    As long as you pay a ccj off in full within a month of getting it then it is expunged from the records and won't affect your credit rating

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    Hospital car parks and residential complex tickets have been especially mentioned.

    The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

    I had received a £90 PCN from Napier Parking 2 years ago on 11/03/2016 for my previous car. Reason for issue: parking or waiting on roadway or on verge/footpath.
    Which location, is it Council owned, or Napier owned? This is important.

    Has the driver ever been identified?

    These BW Legal cases are always, always worth defending.

    Expensive Apartments, looks like private property, but I don't know who owns the property. The driver has not been identified, I was registered keeper of car.

    How can I defend this?
