UKPC Windscreen ticket

Hi,

Just need some advice in regards to a windscreen ticket I received around 12AM in Matalan car park. I have read the Newbie thread several times and the new "UKPC left site" posts and threads but before i proceed i just want some advice please on whether i should challenge it or not.

Matalan closed at 8PM and the ticket was given to me at 12AM for "Vehicle owner / driver left site"

I tried speaking to the retail manager but they refused to help as the store was closed at the time the ticket was issued. I am guilty in the sense that I left the car park, and they have one picture of the driver seat being empty. Do you think it's still worth challenging?

    alternatively, wait until day 26 following the event date , then appeal as keeper using the blue text template

    This isn't your first PCN so surely you have got the hang of the two stage appeal for BPA members, and a landowner complaint, by now?
    You beat MET at PoPLA, now it's UKPC's turn.

    UKPC are scammers. They were caught doctoring time stamps on their photo' "evidence" last year.

    Of course you should appeal, just as Redx has suggested.

    Get pics of the site and signage in the same light conditions as the alleged event as soon as possible.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Remove the sentence about "guilty"

    So, they took a picture of the drivers seat, what about the rear seats, someone could be sleeping.
    That is not proof of "driver/keeper left site

    Ask them to proof this. ...... the person walking off site

    Leaving site is very likely to be an unfair term in a consumer contract under the CRA 2015 imo.

    Thank you everyone.

    Update: today was the 26th day so i submitted my appeal using the one size fit all template. Since, I've won the appeal against MET which I would've paid 100% had it not been for this forum and the help you guys provided. I am going to fight this too, and It's okay if i lose because at least it will feel good knowing i didn't give in.

    You'll win at POPLA, either because:

    (a) they won't send you a Notice to Keeper in time, or if they do, you'll win on

    (b) there is no evidence that the driver left 'the site' or what constitutes the boundary.
