Have been reading this Rightsnet's thread

and this situation is discussed within this thread.
Hope the OP updates us on what happens with her UC claim.
That’s an interesting thread and boy does every angle get covered in it. Unfortunately through reading it they seem to be of the same opinion that it must be a claim to UC because the partner of a claimant is not a claimant and to be entitled to SDP you must be the claimant.0 -
Hi everyone, just thought I'd give you all an update.
I was advised by the SDP team for universal credit that because I had a joint tenancy agreement and claiming housing benefit (I wasn't main claimant, apparently if it's a joint tenancy on a housing association property, it means you both receive HB) and in receipt of severe disability premium that I had to claim income support.
When trying to claim income support, IS actually turned around and said no, that they had spoken to their UC expert and they had clarified that technically I was not in receipt of SDP.
So I made a claim for Universal Credit. Had my interview at job centre etc, 2 days later I get a call from SDP team saying that my local authority has confirmed that I was receiving SDP so needed to claim IS. So UC claim cancelled, started claim for IS and is all sorted now.0 -
