Good evening one and all,

I'm really hoping someone can help with this predicament. Our car was stolen. Land Rover Defender, they are being stolen daily!
Anyway, it's gone, never to be seen again so we are going through the claims procedure. Loss adjuster spoke to us last week and he is telling us the car was written off in 2011. We bought the car in 2010 and I can tell you catagorically the car has never been written off. Why are they doing this?
He said we can accept the offer of £9k straight away as that's the value of a written off 08 plate Land Rover Defender 110 long wheel base. The actual value is nearer treble that

Has anyone heard of scenarios like this before?

  • Some additional information. The ombudsman told us to inform the insurance company they need to check with CUE (claims and underwriting exchange) to find out if the car has been written off. He said, oh we don't use that we use MIAFTR (Motor Insurance Anti-Fraud Theft Register)
Totally separate and unrelated databases. This is starting to smell fishy to me. He's being very evasive. For the sake of saving his company 14k he's going to extraordinary lengths

Have you run a full HPI check on your car? Has it been registered Cat C/D and repaired? Although not sure why if it was non structural and repaired to the correct standard... they should still pay out the vehicles retail value to replace.

Cue and miaftr are two totally separate databases doing two different things. Cue records all accidents and the sums paid, it does not record if the vehicles were written off.

Miaftr records all written off cars and passes the write off status to hpi and dvla.

Cue data uploads automatically from the insurers claims system. Miaftr is manually entered by the claims handler. It is not unheard of for a handler to miss type the registration on miaftr causing the total loss marker to be recorded against the wrong car which is likely to be what has happened here. Only the insurers who entered the car on miaftr can edit the entry so your insurer will need to contact them to get the entry corrected which will remove the total loss marker from your car. This should be very straight forward for your insurer to resolve simply by picking up a phone.

    No way is a 2008 Defender worth £27k - you're dreaming.
