PCN Indigo SE!!!

On the 6th April I parked in a railway station car park. I rang up to pay using their automated service. However the service was down and I did not have any cash. So I got up Indigo's number online and rang that and paid that way. The payment was accepted and it came out of my account the following day.


When I returned to my car I had a PCN on my window. I sent an appeal on the 9th April advising them I had paid over the phone etc.


I did not hear anything back from Indigo so on the 5th May I rang Indigo to ask about the conclusion to my appeal. Indigo said they could not find any appeal and my debt had already been passed to the debt recovery agency. They asked for me to email them the evidence that I had paid so I emailed them my bank statement showing the payment had came out. They replied asking me to ring to conclude the PCN so I did and they did not conclude it. Since then I have rang them between 6 and 8 times trying to speak to a manager to resolve this issue. I was meant to get a call back 4 times and no one rang me back. I've tried contacting the debt agency but there is no option to talk to them it is all automated. I've received my first letter from the debt agency that states I have 14 days to reply from the date of the letter. I put the letter down thinking I'd reply at the weekend as I was working all week. When I sat down to reply to the letter at the weekend the letter was dated 16 days prior. I received the letter with only 4 days left to reply and didn't realise until I sat down to do the letter!!


I don't know what to do! I've missed the deadline to appeal to the debt agency and Indigo can't do anything! The team at Indigo have been a nightmare. The person I spoke to today was rude. I asked who I complain and they said the team manager who is never there. The man also refused to give me his name!


I should not have had that PCN in the first place as I paid to park!


Where do I stand?
What can I do now?

    Never, ever ring a private parking scumpany.

    You can safely ignore toothless debt collectors.

    It looks like you haven't yet read the Sticky thread for NEWBIES that tells you how to deal with these scammers.

    You paid for parking, you owe nothing. Indigo are BPA members so you should complain to them that you appealed but haven't received a PoPLA code and they went straight to debt collectors instead. Include a copy of your original appeal email to the BPA.
    You should also complain to the landowner, SE Trains?

    In future, read up on the best way to beat these scams. Never appeal a windscreen ticket straight away. Never reveal who was driving.

  • I have read the newbie post but that was after all I mentioned in the original post. I only discovered this forum today.

    I appealed via post - I sent it normal 1st class post and not recorded so I can't prove that the letter was sent. I didn't think about sending it recorded but they asked me if it was sent recorded. Also I do not have a copy of the original appeal as it was typed up and printed on a work computer.

    I am going to complain to the BPA - as I saw in the newbie post. Also I have informed Southeastern I am experiencing problems with Indigo and they have asked me to email them the situation and the complaint I would like to make.

    Indigo have said there is nothing they can do now so I need to appeal to the debt collectors agency. Should I still write an appeal to debt collectors agency?

    Indigo are also saying I need to prove I did not get the ticket before I got given the PCN! I explained to them the time given to pay for a ticket via the automated service is 30 minutes. I was called a liar and they said you don't get that long so I've driven to the car park and taken a picture of it for proof!

    I know the time I was given the ticket so I've rang my mobile provider and they are sending me an itemized bill as they are also saying there is no record of my call.

    They are saying a bank statement showing the money was paid to them is not proof I paid for my parking as it came out the following day! Even though my car was not in the car park the following day as I was at work all day!

    If appealing by post, always first class from a Post Office and obtain a free proof of posting. Never use recorded or special delivery as the PPC could refuse to sign for it and thus have proof they Didn't receive it.
    If appealing online, always take a screenshot.

    You have already been advised what to do about debt collectors. IGNORE them.

    Can you get a more detailed bank statement showing the date of transaction, not just the date the money came out of your account?

    The car park is probably covered by Railway Byelaws so you need to do some research about that. I'm not sure how this will affect you if you have admitted that you were driving. Hopefully one of the experts will be along to help soonly.

    You are doing all the right things about complaining and building your evidence. If this ever got to court, who do you think the judge would believe?
