What is the correct way? (eBay)

So I purchased an old iPod from somebody on eBay.
It's never even turned up. I asked for the tracking number and they said they only sent it 2nd Class due to not being able afford the extra.
I'm pretty stumped they couldn't afford an extra £1 or so but now 3 weeks on and I'm still without the item. They have said they have to fill a form in with Royal Mail and wait a further 3 weeks until I can receive any sort of refund.
Now I'm sat here, no iPod and no money. I haven't opened a case I'm unsure if that's the case? Where do I go from here, I would like my money back soon as I need to purchase an alternative as it was going to be a gift.
Thanks

Better to understand a little than to misunderstand a lot.

Open an INR case one day after the estimated delivery date if the item has still not arrived.
Seller will need to provide proof of delivery (which he can't). As soon as you can escalate the case (8 days after opening) and you will receive a full refund.
The seller is correct in saying that he has to wait three weeks before submitting a claim to RM, but that has nothing to do with you. He will also have to wait an additional 30 days from submitting the claim before he received a refund from RM, again not your problem.0 -
Do not close case until you have refund (if seller asks).0
