Credit File Issues!

I am a very unhappy bunny!
Recently unfortunately I could not replenish one of my bank accounts in time so a direct debit was left unpaid (even though having it paid would have made me go only £30 odd over the authorised overdraft.) The account was replenished two days later but the Bank still did not pay the direct debit which was for only £95.15 and not too crucial as it was only to a Life Assurance Company.
I only knew about this from a letter that arrived totally out of the blue. But what really got my goat was (a) a £25 fee for goodness knows what??? but in my eyes even WORSE was (b) they were going to advise Equifax of this 'late' payment which really was not late. I pleaded with them and even spoke to quite senior staff but they refused to budge on either the fee issue or the reversal of the Equifax notification saying it was a 'factual event' and not an error of theirs! The Bank in question was First Direct who I have been with for over 20 years and up to now had been singing their praises! But no longer! Now my worry is I may be declined credit for a new heating system my house desperately needs as the present one is old inefficient and consumes vast amounts of gas. On mentioning this to First Direct the cold uncaring bank couldn't give a sh** and pointed out to me that they had been looking at my Equifax Credit Report over the past six months and noticed there were 'problems' but did not, even when pressed, specify what they were. As it happens I have an account with Equifax and immediately ordered a Report which did not show up anything adverse at all. So are they lying?? Help!!! Urgent advice needed on how best to proceed.

    If you paid late - its a late payment. doesn't matter if it was a mistake you made or not. If you had resolved it two days later its unlikely they would have flagged it so i suspect your attempts to blame the bank delayed the payment further.
    Why should your bank give you extra credit?
    How do you know what the bank would consider potential problems? Maxing you overdraft each month is probably the problem!

    To proceed you need to make sure you catch up with the payment to insurance, pay the fees due to the bank and just carry on.
    You're also worrying about the wrong thing - a single Late Payment on a Life assurance is unlikely to be considered a problem for most lenders.
    However being so close to maxing your overdraft each month is.

    A bank cannot pay the direct debit once the original request is declined. Not how the system works. Onus was on you to make alternative arrangements for payment.
  • Not surprised they wouldn't help - it's entirely your fault as explained above.

    The initial error comes down to poor budgeting, so how you can blame First Direct I don't know.
  • That may be so but the original questions have been left unanswered namely:-

    (1) Why on earth do they have the GALL to charge a totally outrageous £25 whereas most of their competitors manage to charge a more reasonable £6 or £8? Does it really cost them so much more to pay or not pay a d/d than the others?? It stretches credibility to the extreme! And as they are a branchless bank their costs should be much less!! You would have thought after all the mountains of adverse publicity concerning unfair Bank Charges of late they would have listened but clearly they have carried on in their own sweet way totally impervious to criticism. No wonder the total Banking Industry stinks to high heaven!!!
    (2) I may have to seek a FOB ruling on the Credit File Issue as I understand from other posts on this Board that not all Banks do this and certainly not after a two day delay! - purely an accidental one off! And in any event it was not a late payment to First Direct or to a loan/card instalment and if the Assurance Company ask me for the missing payment it can be easily paid from other sources. So really its none of First Direct's business to do this and harm my credit file and I shall be certainly making intensive legal enquiries as to the legality of their actions!!

    In realation to point two it's correct:

    Agreed repayments are one to two months behind.
    • Your overdraft balance has been greater than your overdraft limit for one to two months.
    • Cheques, direct debits and standing orders may have been bounced to keep the account in order.

    First direct/hsbc record bounced direct debits with the CRAs.
