Ticket bought on eBay, never delivered

Hi,

I was wondering if anyone could offer me any advice. In April this year I bought 2 tickets to the Stone Roses gig in Heaton Park for £150. The person who I bought them off constantly re-assured me they would be delivered nearer to the event, then in the week before the event (June 31st) stopped responding to any contact regarding the tickets. As more than 45 days had passed between me paying and realising something was wrong, eBay refuse to open a dispute about this due to their 45 day time limit for raising a dispute. So basically the guy has stolen £150 off me for nothing in return.

I've tried contacting him by telephone and email but to no avail. I've also contacted the CAB and Consumer advice line and they have also told me there is not much I can do. As I don't have his address I don't think it's possible to start a small claim against this person. I have also been told the police treat this as a civil matter and won't intervene.

I am fuming about all this, that there is no way I can retrieve the money stolen from me. Do any of you guys know of any path I can take to rectify this?

    I would say no....

    You will need name and address to start a small claim.

    There are provisions within the data protection act, so you would first need to obtain address from ebay. You may or may not be able to get this yourself - and I would suspect that ebay will probably not reveal this information even though technically Police involvement is not required. Data should be released if its to be used in connection with legal proceedings.

    The Police can definitely help you with this, and they will need to contact eBay and tell them that failing to provide the information would prejudice the course of justice (they probably do this all the time with crimes they investigate). Often such a request will be signed by an officer with a rank of Inspector or above.

    If Police wont help, and you hit a wall with eBay, the only other option would be to get a court order from the county court forcing ebay to reveal the sellers details. You should not have trouble getting this, although it will cost you.

    Another thought might be to look the buying history of the seller, and contact a user who has sold something to the seller. Ask them for the address they posted the item to?

    Was the seller genuine eg 1 with a reputable ebay rating ?

    Hi, I shouldn't say this.

    When I was 18 I had a gambling addition and sold goods on ebay I didn't have to raise funds to gamble. I was arrested for deception and given a caution. If you phone the police they will investigate, contact ebay for the persons contact details. If they police can prove he didn't have tickets to sell he will be arrested and you are likely to get your money back.

    I will contact the police! I don't think eBay will give me the guy's address due to data protection? However I do have his phone number, whether this is any use or not I don't know!

    hi,

    have you tried getting the contact information from the ebay advanced search button?

    if you click advanced search at top, you can then get contact information - if you put in their user id and the item number you both traded with - this "should" bring up their registered details

    I say "should" as they may have put false details/ wrong details etc, - but it is worth a try

    I have tried this, but unfortunately it only returns his phone number and the city he lives in. I've tried ringing the number given but he isn't picking up unsurprisingly..

    Did you pay by card? If so you may be able to raise a Chargeback via your card company. Given the concert is not until 31st you would need to wait until the post was delivered that day to show that the goods were not received.

    the concert has been and gone, it was the 31st June.. I have called my bank and initiated a Visa Debit chargeback, and from what they said I am quite hopeful :) They are sending me out some forms to send back to them..
