    No forget any of that,
    Its quite simple put together a counter claim , get the wording right, and pay the fee, you will need to do it the same time as you do your defence.

    Just received my SAR request back and if VCS are relying on their photos then they have no chance. Absolute chancers.

    If this is happening regularly, then you should also be raising this with Trading Standards.
  • Just a quick question. Can i email my witness statement in or does it have to be a hard copy posted to my local court?

    You are best advised to hand deliver your paginated bundle of witness statement (WS), evidence & cost schedule in a ring binder with a colour coded contents sheet to the local court. This way you can get a receipt and there can be no doubt it was delivered. Courts sometimes impose a limit on how much they will print. Worst scenario would be for you to turn up on the day of the case and for the judge to be sitting there with no papers in front of him/her. You can of course e-mail the WS to the claimant.

    If you do choose to post it, just first class with a free certificate of posting.

    Have another look at your Notice of Allocation.

    Does it say something like...
    Each party must deliver to every other party and to the court office copies of all documents on which he intends to rely at the hearing no later than [ . . . ] [14 days before the hearing].
  • VCS have issued a "Notice of Discontinuance" after seeing my witness statement!
    I'd class that as a win!
