Help got letters from debt collection not my debt

Hi my oh got 2 letters this morning from a company called debt managers limited. One in his name and on in his and his x wifes name who he hasnt seen for 7 years.

He has no idea what these debts are for . Should he ring them to find out or would it be better to write?

We have been together for 5 years so they must be from before then.

    if these debts are that old, there is a very good chance that they are statute barred.

    What this means is that the debt still exists but the creditor cannot pursue your OH throught the courts. The courts and the OFT have rules that if someone tells the creditor that they are not going to pay a statute barred debt, then it is against the rules to pursue the creitor any further.

    Some will try it on and one or two have really tried it on and got egg on their faces when they came up agaisnt someone who knew the rules.

    The debt dating from his ex's era will probably be statute barred unless there is a CCJ outstanding. The potential nightmare with the joint debt is if his ex has made payments in the last 6 years, which would mean the debt was not statute barred

    The other debt will be if it was last paid over 6 years ago.

    Do not ring. Ask OH to think it through a bit more. Can he contact his ex?

    Please never ring a DCA about a debt, particularly when you are uncertain of the status.

    1. The staff are trained to push you into immediate payment. It is not at all unusual for peope to come on here having paid money to god knwos who.

    2. If you are liable for the debt, then you need the proper paperwork from the DCA before you pay anything.

    3. Phone calls allow the DCa to suggest dire penalties and make suggestions re payment that they would never dare put on paper as they would be in trouble with the OFT and TS.

    4. You need proof of wht you said to them.

    He hasnt spoken or heard from his ex for 7 years. He doesnt no where she lives.

    She changed her name after they devorced too. One of the debts is for thames credit- halifax plc current account. Oh has never banked with halifax.

    Other one is aktiv kapital al does anyone no what this is?

    Can he request proof of debts as he hasnt applied for any credit so his signature wont be on them.

    Hes really annoyed at the mo!

    AK are very wll known on here. is this the debt with both names on?

    Re the other one, does OH have a fairly common name? Not at all unheeard of for DCAs to send everyone with a similiar name letters hoping to flush out the owner of the debt.

    You need different letters. Will be abck with them but have to do other stuff as well.
