Cca Problem

I have a bit of a problem here and need advice. A Few months back I asked for my CCA from Next which was going through Moorcroft. They replied saying they do not have a CCA etc, So I told them where to go etc.

Now 2 months later they are back in touch saying they are going to commence legal proceedings etc etc and that a doorstep agent will be calling.

What do I do now?

    Probability is that it is hot air to try and get you to pay again. Did they say in the previous letter that they had not got your credit agreement or something that made you come to that conclusion? If it were me i'd file it under 'no need to action yet' If they do go to court you can SAR them as part of your defence to make sure they haven't found one and even at this point you can make an offer if you feel so inclined.
    June 2005 = 48K of Debt:cry:
    Sept 2006 Started dmp = 56k of Debt (inc fees and charges) DFD April 2030:eek:
    May 2008 = <5k of Debt (CCA route -48K, paid off 3K) DFD April 2010
    Nov 2008 Lloyds found CCA for 14K loan:mad: New DFD Jan 2016

    Happy so far tomorrows another day:confused:

    Hi there

    do you have proof you sent the cca request and do you have a letter from them saying that they do not have your cca. If so i would say you are sitting pretty and i would let them take me to court because they are now the ones who are in breach of the law. There is a couple of people round here who can give you more detailed advise but i would say sit tight for now and dont worry........ :beer:

    I have it in writing from them that Next do not have my CCA but his does not release me from making payments

    It is your choice, you already know that after 12 working days if they have not supplied your credit agreement then you can put the the account in dispute and within the law you are entitled to with hold payment while the account remains in dispute. The only rider to this is if the account as already been to court and a payment scheme was arranged by the judge' in this case you cannot stop payment but you can ask to go back to court to have it reviewed.

    if you think that you must keep making payments, then what is the point in requesting the cca. That is the whole reason for asking for it, like kel123 says if they do not provide you with the cca they cannot enforce the agreement and after 30 days they commit an offence.
