It was a man she met and was taken in by.
I know it's difficult for lenders to establish whether the person understands and that they are borrowing of their own freewill but don't you think there ought to be any guidelines or protection?0 -
and there is - I mean i saw a lady who told me she was a millionarie but she wanted to borrow money to buy a horse for her grand-daughter - she din't have a penny to her name really, and i politely said this was something we could not do
but she was insistent -its hard not to cross the line with discrimination0 -

INCISOR - I feel you have got the wrong end of the stick. I asked this question not for prosecution purpose but more for personal knowledge and in order to help the Vulnerable Adult. I want to be able to assist him to get his debt cancelled and NOT in order to prosecute. He has a social worker who is not very good with technology and i offered to, in my own time, do some research. It appears you may not think much of the Police and the CPS, im sorry you feel that way and i know from experience that there are many thinks that may lead you to think the way you do but please dont class every officer as the same, there are some of us young in service with the motivation to do whats best for the Victims and Witnesses instead of just chasing detections and arrests. I hope the next interaction you have with the police and CPS is a positive one.
To everyone, like i said its more of a research thing so the experience's and links are greatly appreciated.
I agree that PC has gone mad and sometimes we cant do right from wrong, i have to work with it and around it on a daily basis.

I recall that part of the law of contract is that both parties entering into a contract must be "of sound mind". If one of them is not (as sounds like may be the case here) then the contract, i.e. the credit agreement, would not be enforceable. I would guess a judgment of whether he was "of sound mind" would be something a court would have to rule on?
I think professional advice would be appropriate anyway, from CAB or perhaps one of the mental health charities can help?
