Confused over agreement request

Hi,

Well after my previous post i sent off a request for my credit agreement to Call Serve on 11/06/08 so the 10+2 days are up this Friday 27/06/08 as I think its twelve working days I have to give them, well today 24th I recived a letter from Debt Managers ltd saying We have requested a copy of the singed agreement and deed of assignment from our client and will rever to you once these are to hand.

Hang of I sent the letter to Call Serve and have been paying call Serve but the letter is from Debt managers, am i still right to think, that they still have to send the agreement by this Friday 27/06/08 before it enters default then if they dont send it by Friday can I then just tell them to sod off and what happens if they sent it after Friday's date.

    so what happens if they dont send in 12 days...are you really going to default payment... i t ake it your not in a DMP or with CCCS or in an IVA

    Yes, if they don#t send it, Im going to stop paying it, it's only £149 and no im not with a dmp or in a IVA, and really its my only last debt, anyone else able to help ?

    After 12(+2) working days after receipt of the request, if the CCA is not provided then the debt is in dispute and not enforcable (outside of court). Whether they are trying to get hold of the documents or not is irrelevant - they have a legal obligation that they have not met.

    From the date that the debt went into dispute, they should no longer be applying charges or interest to the debt and you are not required to make payment towards the debt.

    Did you send the £1 payment too?

    I would just send the 2nd letter but send it to whoever you made the request of.

  • Yes I sent a 1 pound postal order with the letter and never signed it, so I was right they have to friday to produce it, I was going to say, they should already have this information if they have bought the debt, so shouldn't need to request it. My main worry was I sent it to call serve but got the reply from debt managers, so are these pay one in the same or not ?
