    To back up the "six months" bit about the default, this is the Information Commisioner's guidance.

    From: Technical Guidance Note - Filing defaults with credit reference agencies
    Time framework

    Although there will be some flexibility in the definition of a breakdown, we believe there should be general rules for the minimum period of arrears which should exist before a default can be filed. Equally there should be a maximum period after which, if anything is to be recorded with a credit reference agency, a default must be filed. The following are in line with the practices currently adopted by most lenders.

    • Accounts should not be routinely filed as being in default where full payments or those due under a rescheduled agreement are fewer than three consecutive months in arrears.
    • Accounts should normally be filed as being in default where those payments due have not been received for six months.

    This time framework only relates to filing defaults. It does not affect the lenders’ ability to continue to report accurately on the extent of arrears using monthly status codes. We recognise that may not always be appropriate for products which advance credit over either a very short or very long-term.

    If the debt was paid off in 2000, then there should be no account details on her credit file for them to default.
    If the account details are still on her file, then it should state exactly when the debt was repaid.
    Donedoingdebt Lightbulb moment January 2000. Debt at highest approx £102,000. Debt now (October 2009 - absolutely fork all!!!):beer:

    Sounds like they may have registered a new one, which is completely out of order.

    Not that uncommon for "pond life" like Thames/Aktiv though. :mad:

    The same company have sent me the exact same letter. 20Legend, did you send the response Fermi suggested? Have you had any success with it? Has anyone else had these issues with Thames Credit/Aktiv Kapital?

  • Hi All,

    Great news and many, many thanks to Fermi. We finally received a response from Thames three weeks after sending the letter suggested by fermi.

    They stated that after our telephone conversation???!?!?!?! I didn't ring them so this must be a standard response that they have ready to send. That after our telephone conversation they have investigated the matter and acknowledge that they cannot enforce any debt through the court and they are closing the account and will no longer contact us. They have also removed the default from the credit file which is now clean again and looking very good as it was before Thames got their grubby hands on it.

    Once again I cannot thank you enough Fermi.

    Hope the outcome of this battle with the morons at Thames will help others.
