bamboozled!

:confused: firstly very sorry if this goes in wrong place, and if it's moved thats fine but wondered if anyone can clear stuff up for me ....i have been lookin round the sight and there seem to be lots of 'similar' cases but i need specific help and advice if anyone would kindly offer me any ;) please?!

i had a card with dorothy perkins ge money and regularly used this and paid without fail each month ....balance varied up to £2,000

over summer last year husband and i had a seperation and i moved back to my home town and rented a house .... and fell behind with my payments :o at this point balance was just under £2k...after 3 missed payments it said on bottom of my statement that viking collections were dealing with my account...

i rang DPerkins NUMEROUS TIMES and offered to make small payments but said i could not afford to pay arreas but would pay what i could - they told me they couldnt take payments as it had passed to viking DCA....

i rang viking and said the same to them - told they could only set up a three month payment schedule which would then clear arrears which i didnt have! so again no-one would take my offers of payment

.....i complain and complain to DPerkins/GE money - loads of phone calls later and letters - i get a letter off GE which after all the long winded blah blah twoddle says at the end

quote " AS PAYMENT TO BRING YOUR ACCOUNT UPTO DATE WAS NOT RECEIVED YOUR ACCOUNT HAS NOW BEEN SOLD TO CL FINANCE"

nothing at all received from CL finance.....
waited and waited.......

made the phone call to CL finane chasing it myself as by this time - end of february im getting worried.....heard nothing else from anyone....

moved back to try and reconcile my marriage.....(goin great just for the record :rolleyes: !!)

told by CL finance that interest is being added etc and if i dont pay a court letter will be sent - RE a CCJ

as many of you can imagine i felt sick with worry and panic, endless sleepless nights and stress!

i am told a CCj form has been sent to me??? - confirmed was sent to where i had been renting and no longer living, i was told tough it had been sent end of. was feelin very weak at this point and had not been on this site! agreed to pay £880 a month for three months and was told needed do nothing with claim form (NOT THAT I COULD ANYWAY I HAD NOT GOT?!?! - have seen some of u have said this but i genuinely have never had!!)

so...i paid £880 march 08....some towards april then was beginning of june when i managed to get £1,872.07 together to clear these horrid ppl....but at the end of may i got a letter from a court saying "JUDGMENT FOR CLAIMANT IN DEFAULT" i had untill june to pay and paid last week. :T


BUT....here are my questions ....any help gratefully appreciated!!!! thanks in advance!


1. if the letter sayin judgement dated 19th may - if i have paid in 1 month do i therefor not have a CCJ?

2. can i do anything about no initial letter or anything telling me they had this account? im told its a blue form if that helps?!

3. i had LOADS of charges added on - can i claim back these hundreds of pounds? who do i claim off - GE?

4. "costs" have been added into the amount ive paid what are these for??? court???

5. anything else i can do or am entitled to ? - even though ive paid? seen things about letters should be sent to say they own account??

cos scrimped and saved my but off to get it cleared in 3 months! :T but still makes me :mad: feel ive given in - but did it for my own sake was stressin me out!!!

but cos ive seen bits of things u guys and gals have done to help others thought someone will advise me

    Hiya Kel,

    Just to clarify, is the Judgement paperwork a form N30, should say in bottom left corner? If so, and you have paid the debt you can ask for it to be satisfied and in some cases removed.

    Hi - thanks - yes it has a n30 at bottom left....?...whats that mean?....i did pay within 28 days too.....has CCJ stil been enterd then? cos i have seen different advice about payin in 28 days and dont know which is correct?!

    In that case, you can ask for it to be removed from the county court register. Ihave done it before but need to check the process. I'll look through and let you know shortly.

    just been scouring more helpful sites but most talk of 'setting aside' debt...i didnt do this?! just paid it.....sites talk about all different forms yet none mention a form for removal? or confirm if no ccj if u pay in 28 days...hence my confusion!

    Hi kel

    If you have paid the judgment amount in full you need to obtain a letter from the creditor that states the judgment has been paid and the date that you paid it. Once you have received this letter you can then forward a copy on to the court where the judgment was issued for the CCJ to be cancelled. There is no charge for this unless you want a copy of the certificate in which case you will need to send a court fee of £15.00 and the court will provide you with a copy of the certificate. x x
