Unsure Where I Stand

I'm unsure where I stand with a debt.
I started a debt repayment plan 8 years ago, everyone was accepted except for American Express who cut off all contact. Last spring I heard, by phone, from a credit collection agency (AIC in Glasgow) wanting settlement for the debt, no payment was made due to unemployment, so they told me they were sending it back to American Express.
Yesterday I have been contacted by phone from another agency UCA in Preston threatening legal action, I'm unsure as to what to do next as I'm still unemployed. I owe 4,000 pounds that I just don't have, I have no property or major posessions. Could somebody give me some advice as I feel extremely vunerable, I don't want to say or do something that I shouldn't.

Where do I stand on the Statute of limitations on Debts?

    If no payment has been made in the last six years , debt is statue barred . The template letter is about somewhere .

    YOu have to have not paid for over 6 years so it depends on when you stopped paying but also you have to have not contacted them or acknowledged the debt.

    If you have you would be better negotiating a payment plan with them and there are templates on the national debtline website for that.

    thanks, no I've never made any repayments since the initial repayment plan was offered..
    One question. If I send a letter stating the debt is statue barred, is that not admitting that I owe the debt?

    Not if you use the correct standard letter.

    Just wanted to post an update.
    I have stuck to my guns and sent out the Statue of Limitations letter as suggested. I have been recieving calls from UCA about an 8yr old Amex debt everyday for the past 2 weeks. The girl on the other end of the line - Tasnire I think her name was, told me that: We have recieved no such letter, upon which I told her I had sent it registered post and offered the tracking number. She said that 'the debt wasn't old as they had just bought it in June 2008 from Amex"
    I recieved another call today from them - Bev Jenkins. I told her the same, I said " I doesn't matter when they bought the debt from Amex" to which she replied " We haven't, we're working on behalf of them"
    There not getting their stories straight, one of them is lying.
    If I didn't know where I stood I'd have gone nuts by now.
    She (Bev Jenkins of UCA) finally said they were contacting Amex and I hung up. I wonder if they call again tomorrow?

    There is a "you have ignored ny Limitations letter" letter somewhere. Will try and find it but I have to go in 10 minutes.

    in the meantime, well done for sticking to you guns.

    Refuse to speak to them again and insist on all comms in writing.

    Well it's 4.53pm and no phonecall from UCA today for the first time in 2 weeks. Wonder if they've finally located the Statute Barred letter.

    When I set up my repayment plan with DAWN (Debt Advice Within Northumberland) who were terrific, everything was dealt with hassle-free & smoothly. I know that when it happens to you, you think there's no way out, its terribly frightening. But talking to the right people right then and there can give you back a good nights sleep.
    My creditors were great ( RBS & Barclaycard ), never threatening or aggressive - my payments were in on time 1st of each month, and none were missed. Of course had Amercian Express taken the original offered repayments and not thrown their toys out of their pram - the debt would have been cleared by now. When will they learn.
    So thanks for the little snippets of advice to those who gave them.
  • Well. After I had the final phonecall from UCA in Preston, they ended by threatening legal action on my Statute Barred debt, to which I replied "Good luck". That was the last I heard from them, they passed it back to American Express. that's now the second Collection agency that have tried to recover the debt.

    The debt has now been passed onto Moorcroft in Stockport, they've isssed me with a PRE-COURT division letter, from what i've read - their full of hot air. And they issue the same letter to everyone.
    Will be interesting to see how long they take to crack. If anyone has any experience of Morcroft please let me know what their experience was.

    there is a letter somewhere what says basically dunno why you are chasing me, already told the previous lot the debt is time barred so leave me alone and don't you dare pass this on or i will report you to everyplace i can think of.
