Newbie - EX planning banckruptcy could this implicate me?

My ex partner has recently informed me he is moving to Australia within the next couple of weeks (he has known longer than this but failed to mention it). After our separation nearly a year ago my ex decided he wanted to keep our house (I wanted to sell) and offered to pay me out, we agreed on a sum and he decided to borrow the money from family rather than re-mortgage the house for more. I immediately on moving out changed all household bills into his name and took my name from the council tax etc however along with the money the removing my name from the mortgage process has never materialized. He has now told me he plans to file for bankruptcy before leaving and I am worried as to how this will affect me still being co – owner? We also have a loan against the property also due to bad advice. I am completely unable to afford the mortgage and loan on my own and have had to seek help on other debts I occurred through helping him due to his lack of financial responsibility previous to our split (my own stupidty I know). Please can you advise me on whether he is able to do this and where I will stand should he and what rights I have or what I can do to help myself from getting further into debt or is bankruptcy the best way for both?

I definately think you need to seek professional help with this.

If he goes bankrupt, there is virtually no chance of you getting the money he owes you and any joint debts you have will become your responsability.

You may want to contact the free debt charities. Not sure if they can help, but hopefully they can advise of who you should be asking and what to ask about.

  • Thank you, I am arranging to see a lawyer ASAP, No kids thank god but i know full well he plans to either claim bankruptcy before he goes or basically just plans on leaving and forgetting about it all. He is in debt himself and basically as always burries his head in the sand about it, this is his way out and unfortunately hes the type who always seems to get away with it. I dont care about the house, apart from him refusing to pay me out now but I simply cant cope with anymore debt especially not while he gets away scott free to start a bew life. Thank you for all your advice I have no knowledge in this area so its all appreciated. :)
