Debt sorted, but now being harrassed?

I apologise if this is in the wrong section, basically i owed someone some money for a job i did a couple of years ago, this was settled out of court through his solicitor and full and final settlement of the debt was confirmed by letter after a sum was paid.

However, it now appears that i cannot be left alone as i recieved a message from the guy saying 'i got off lightly' and did not resolve the issue to his satisfaction. As legally this is now done and dusted, where do i stand legally to maintain my right to privacy and to get on with my life?

    Report him, the matter has been delt with and if he didn't like it he should have said so at the time.

    I think he is breaking the law to continue to harass you.
    When I had trouble with an e-bay buyer making threatening phone calls I was advised to go to the police. As I had let it go to answer-phone I had the evidence. Mine didn't go that far, but apparently the police do take threats seriously.

    I would log any contact but ignore for the time being. If this becomes a nuisance you can look into getting an injuction but this would mean paying a Solicitor. Do make sure you keep all nessages and log any calls etc as they would be evidence if you did go down the legal route.

    Ok thank you for the advice. It was sent as a private message and has now been saved.

    This is the first contact i've had since the matter was closed last week, the issue has been ongoing for a couple of years and has already caused alot of stress and sleepness nights for myself and my family.

    Whilst the situation that occured was mostly my fault, i feel that as it is now settled, we have a right to move on from this and the actions of the person involved is quite frankly childish, i suppose i expected this from someone that told me he was going to take me to court via a text message.

    I have contacted CLS as if the harrassment continues i need to know what action i can take to put a stop to this. I cant afford a solicitor either, so to some extent i may have to put up with it.
  • if he is demanding money from you thaat you do not owe and is harrassing you make a complaint to the police do not take any waffle from them about it being a civil matter if he is demanding money etc that is not owed it is no longer a civil matter.

    Money is not being discussed, the issue is how i dealt with the matter, he feels i did not communicate with him enough and that i let it get to the solicitor stage. In all a pointless debate, as he accepted my offer as full and final settlement, i'm not sure what he wants now as on previous occasions i have apologised to him over what was a deeply regretable set of circumstances and it seems now, despite it been sorted i am being made to suffer, to be teased and wound up about it.

    I already suffer from stress and have enough going on in my life with a 3 month old son, having to move from rented accomadation to temporary because we cannot afford to live and it all adds to my misery, i just want an end but it seems i'm not being given a chance to move on from this.

    A small update, i have until this week continued to receive threatening and harassing messages from this guy, i wrote to his solicitor and requested again there be no further comment made but all i have received back is a message from the person direct saying 'he got my letter', which is odd, as it wasnt sent to him. I am choosing to ignore him for now but have evidence of these harrassing messages and posts made on internet forums misleading people into believing that the matter was not resolved and making personal attacks at me. I'm struggling to find anyone that will take me seriously, i dont want to take legal action against him, i just want to be left alone in peace, its not much to ask.

    Not at all any legal expert but wouldnt the "stalking" law come into this somewhere? thats if he's dong stuff he shouldnt.:confused:

    Might be worth reading up on.

    Hi GarethK,
    Good luck in getting this resolved, just thought I would give you some free legal advice :-)

    Essentially there are two laws in the UK that can help:
    - Criminal Justice and Public Order Act 1994, this law does not apply to those outside England and Wales
    - Harassment Act 1997

    As you have the persons solicitors details I would advise that you write to him and inform him that you wish to cease communication and all contact with this person, that you have dealt with a settled your previous grievance with this person and therefore do not see any reason to have continued discussions.

    Provide a log of times when you have received unsolicated contact from this person, including comments and any replies were you have asked this person to no longer contact you.

    If you can provide a screenshot/print out detailing these.

    Advice if you receive any further contact from him that you will contact the police.

    A breach can lead to a potential 6 months inprisonment and/or a £5000 fine.

    Send the letter recorded/special delivery so you have prove of receipt for this document.
