Oohh could be in trouble here

I first posted a couple of weeks ago and someone very kindly pointed me in the direction of the MS Society so that I could apply for a grant to pay the bankruptsy fees. Last week I also decided to apply for a crisis loan:rolleyes: . I told a fib and said it was for something else. The DWP have said I can have the crisis loan and pay it back at £3.03per week. I have not yet heard from the MS Society.
I don't know whether anyone can help with these questions.
1) If the MS Society agree to pay the court fees, should I just keep the DWP cheque and send it back to them or should I cash it and keep the money in the house for emergencies?
2) If I keep the cash, is the OR going to require a reciept for the .. eerrrr "washing machine" when I finally go to court to file for bankruptcy?
3) Or should I just tell the OR what I really used it for & tell them I fibbed to the DWP?
I'm not sure whether the above makes any sense to you - it does to me!:rolleyes:
At least now I can move forward and get a court date sorted which in itself is a vast relief. Its odd really, I had resigned myself to the fact that I wasn't going to get anywhere, so had made the decision on sunday to pay no-one & just save for the next 3 months.

To be honest,I feel it is always best to be honest!
I abide by that anyway,but if I was going BR then I think you should be straight down the line rather than trying to remember a lie.
If the MS society agree to help I personally would inform DWP and return their cheque-one less debt to worry about!Tomorrow is always fresh, with no mistakes in it!0 -

BR and all it involves is difficult enough without making things harder for yourself by lying. *If* you're found out then the OR will not be amused and really...... he/she is not a person to annoy. Co-operate and be totally honest about everything and you'll have nothing to worry about or fear - start lying to the OR and you're just digging yourself a big hole - they can and do make life difficult if they think you're not being co-operative.
Tell you truth - it's much easier to remember!You can't control everything in life....... your hair was put on your head to remind you of that

How much was the loan for if you dont mind me asking (actually scrap that it's irrellevant)
If the MS dont give you the loan then I would advise that you stop paying your creditors as you know you are going BR. Use this money to save for the Br fees, this way you are not entering in to any new form of borrowing knowing you are imminently going to be BR.
This way of funding BR is seen all the time by ORs and is the norm. This way wont get you in trouble whereas keeping the dwp money will.

I agree with the above advice..
I would just take what you actually need and then you have one less thing to worry about.
Going bankrupt is so you can forget about money worries, if you take the other loan then you are just going to spend the next 12months worrying whether the OR will find out.

I am still hoping the MS Society will come up trumps. I only applied for the crisis loan out of complete desperation. £309. I had already decided to stop paying everyone two days ago and reckoned it would take me about 3 months to get the money together.
My thinking was and still is that if the MS Society can't/won't fund the bankruptcy, I will use the crisis loan to pay the fees and just tell the OR what I really wanted/needed it for. I suppose the DWP areused to people having crisis/budgeting loans from them and then using the money for something else.:rolleyes:
I'll wait until the end of next week - surely I will have heard from the MS grants team by then!

I took no proof that i'd been in contact with CCCS. I suppose if there was any doubt then this information could be requested (e.g. if it was pretty obvious you weren't insolvent and shouldn't really be going BR and had claimed you had taken advice)
And.. no you don't have to keep every receipt though it might be worth doing anyway for your own benefit in order to help with budgeting? My CAB adviser printed out my forms and went through with them bit by bit with me. When he had finished he actually stuck a post it note on the front saying it had been checked through by CAB. At court I think it actually saved the judge and myself alot of time because he actually said 'I see you have taken advise on the matter' so I didn't have to explain too much on the day to the judge.0
