Baliff Help

Evening All, A little advice if anyone can help would be appreciated.

This morning was going really really well, until... I went to my car and realised it had been clamped for an unpaid PCN. Which to be honest I didnt know about... so £340 later here we go,,,,, i was in debt to start with but more now.

but can anyone help me out on this one. In May last year, I had a job interview, and was late and parked on a double yellow. Got a parking ticket. I didnt have any money at the time, so ignored it - stupid I know! I then got a letter about it in november from Jacobs Certificated Baliffs, which I spoke to, went a bit mental at, pretended i didnt have the ticket etc, and then wrote a cheque to pay them, asking my partner at the time to post the letter for me.

I was speakign to my ex this morning (we are now on speaking terms, but we were going thru a shakey patch at the time). On telling him what happened this morning he started apologising prefusely etc, on further conversation he confessed he never posted my cheque or anything, and I stupidly didnt watch for it going out of the bank. Now I am in a dialemma, and paranoid about myc ar being clamped and towed. What do I do... I am thinking,

1. call them, and apologise and make the payment £108.00 and explain the situation
2. write a post dated cheque and letter and post it, hoping they think it has been lost in the post
3. ignore it as no correspondance

What rights do Certificated bailifs have? Will I be able to negotiate a payment plan if the debt has gone up?

I have parked my car on a completely different street etc this evening, because I am scared I will be greeted by another clamp and have no way of getting to work.

    I know nowt about bayliff type things I am afraid. If you can track down a user called herbie21 they are a bit of an expert in this area. I think they have a website called bayliffadvice or something, if you can find Herbie21 thne I think the website is on their profie. The answer may be on that.

    If they are balliffs, you should keep your house secure, and windows closed , as they can get in to collect other items , as long as they dont break in ..

  • No not had a court order for the fine. Just a nitice of enforcement from them.

    I would contact them and make a payment arrangement hunnie,,

    I honestly dont think they, ll go away .

    But dont be bulllied into making repayments that you cant afford..

    Stick to your guns ,If in doubt contact Citizens Advice , they could do it for you




    Best of luck & try not to worry. I hate to see people so upset debits a horrible place to be in ( been there done that got the T shirt :D )

    Hi there,

    I have recently been in the same situation, the difference is i brought a ticket to park for 5 hours got back to the car with hours left on it and had a parking ticket - i called them straight away to ask them why they said they couldn't do anything unless i put it in writing! So i put it in writing kept my ticket as evidence i heard nothing - i thought it was all finished with till January (2 Years later) when a baliff knocked on the door and asked for £300 odd pounds i explained the situation to them and they said they would give me time to do a stat dec etc. I did this sent it in didn't hear anything till eight weeks ago when they knocked on the door to say they had clamped my car and wanted £586 i was so mad.... my partner came back from work and the baliff called the police who sided with the baliff! They said they would remove the clamp when they recieved another stat dec so rushed around all day did what they asked then they still refused to remove it. I got the result back from the stat dec and they refused it saying i could appeal in a court near me i still have the parking ticket proving my innocence but no one will listen!
    I know this does not answer your question but through all this i have found a little out.
    1. You should ask for a breakdown of costs as this has still not been done to me but it is procedure the baliff should follow.
    2. If you invite him in he can enter your propety when your not there.DO NOT LET THEM IN!!!
    3. County court baliff will probably never be able to get a warrent to break in to your premises!(but can enter if unlocked, window open etc.)
    4. If your car was to get clamped and the lock ACCIDENTLY got broken and replaced with a lock with one of equal or higher value to say sorry this way it is not actually criminal damage!
    But they will probably find a way of getting past all of this just as they have got away with clamping my financed car(finance company have asked them to remove it also!)
