help

ive been in a iva for 13 months and managing well but ive now lost my job so ive missed 3 payments i have debt of £27000 but now all i get is £500 a month and i get £140 a month off my son my rent is £200 council tax £70 gas £60 electric £30 water rates £35 can the ivp make me bankrupt i need some help on which way to go:o

    welcome am off to bed but please ring one of the free charity helplines in my sig they will give you some proper legal advice. Check the terms of your IVA and see if there is a clause that says they will make you bc if you default.D

    I totally agree with Dalip you need to contact one of the debt charities.
    Have you done your Statement of Affairs (income & expenditure) yet, without payments to debts? If you put this up on here then the someone here will be able give further guidance. You will also nned this for when you speak to one of the helplines.

    what happens when you go bankrupt do you have to appear in court or in front of a judge

    Usually yes, but it's not as bad as it seems .. just you and the district judge.

    The judge will ask you if you've taken advice (from cccs, cab or national debtline), ask you if you realise the consequence of what you're doing (i.e bankruptcy) and then stamp your form.

    Sopme people haven't needed to see the judge, just depends how busy they are.

    also if i go bankrupt has this any effect on my 23 year old son still living at home im in debt with barclays and he banks there would it be nessacary for him to change banks as he has a current account and savings please help me

    As long as your finances are totally separate and you don't own property with him,I don't think it will affect him financially.

    If you are on benefits,are they aware that your daughter is giving you £140 each month?

    i dont receive benefits i am working part time all my debt is in my name we have no property but he is saving to be married can they include this as he has £2000 saved
