Court tomorrow - What to expect?

Hi Guys.

In 2001 i was approached by HFC bank to take a loan to consolidate some credit. The way they explained it to me, they said it was they who supplied the credit for a PC that i had had from Dixon's some months earlier. They said if i went directly to them it would be cheaper.

Well the it turns out i had a loan for £3000, Anyway after 7 Years of paying - admittedly at a reduced payment. They have said i still owe almost £4000!!!

Well it turns out the interest rate of this loan is 26.2 % Apr (whatever that means) and i have found out they have added payment protection insurance. they explained none of this to me, i was out in about 15 minutes if i remember correctly.

In November 2007 i wrote them a complaint explaining that none of terms of the loan were explained to me properly and to complain about the £1500+ in charges which had been added. Basically i got a go away response, which said if i wished i could complain to the FOS within 6 months of the letter, Which i did in Feb

2 days after receiving this response i got the court papers through and my case is tomorrow. I have chose to defend part of the claim and admit to 600 as i have paid over £4500 so far and i am still paying £89.00 per month which i cant afford

I have had 3 letters from the FOS saying they are busy at the moment and have not yet assigned the case.

Well tomorrow i go to court about this , I was wondering if anyone had any advice or tips. What should i expect ? will i have to stand in the dock etc. I am nervous and to be honest quite frightened about what will happen

Any help appreciated, it may be a bit too late now eh? was i right in letting it go to court?

    Hi.

I didn't want to read and run. Someone will be along shortly who'll have some great advice. You're not alone.

    Good luck tomorrow. x

    Hi Guys,

    Thanks for the replies :p

Just to let you know i went to court about this today, however the judge could not make up his mind because i have complained to the FOS.

He has Adjourned the case for another 42 days so he can clarify some things on the statements and hopefully i will have heard more from the ombudsman by then

I was wondering if this has happened to anyone else? is it good or bad?

This was my first time at court but i was glad i didn't have to stand in the dock lol.

Instead it was just a room, however the judge more or less pretended
I wasn't there and i only really spoke once. is this normal?

    Thanks in Advance

The Judge has to be seen to be even handed and not appear to favour either party. It is not his job to smile at you just be fair , which it seems he has been . Did the other party attend ?
