What would happen if................

Hi Folks.

I have a general question to ask before I post my main query and hopefully someone will have a definitive answer.

When submitting the forms for BR what would be the penalty if they were found to be incorrect at a later date? By this I mean not declaring any part time earnings to the OR at the time of filing the bankruptcy forms.

What course of actions does the OR have if that is proven to be the case? and if the individual actually made a financial loss via the part time work, would the OR still take any action?

    YOu will prob get in trouble, have a Bankruptcy order slapped on you for upto 15 years, and kiss any early discharge goodbye.

    Classed as being unco-operative with the OR. bru/bro for 2-15 yrs depending on the crime.D

    you need to be open and honest with the OR the more honest you are and the more information you give them will help you, hopefully to an early discharge if you are found to be uncooperative with the OR or they find something you didnt tell them you could end up with a long bankcruptcy!!!!!

    Many thanks for the replies.I missed a bit out in that this scenario is after the date of the discharge whereby undeclared earnings come to light :(

    as others have stated - looking at being uncooperative with the OR and fraudulent - Possible BRU/BRO as per dalip. By the way maxmycardagain love your signature! he he

    Thanks all :) From what I have gathered from looking at this problem, each case is treat on its merits but normally ends up where the case is re-opened and the final date for discharge is many years hence. grrrrr.

    I have my post almost ready but have to trim to under the 5000 characters the site allows, lol.

    All will become apparent shortly.

    If Tax is paid on the part time earnings the OR would find out anyway.It's not worth the aggro.Best to declare everything.
