charging order on property somebody help please.

:confused: i guess everyone has a story,well this is as honest as it gets.i developed a debt of 37,500 pounds with a very un-helpfull h.s.b.c i was offered loans to pay loans all the usual stuff,and then i pleaded to them to extend the duration of the condensed loan to reduce payments,as my credit was intact still and untill this blip had been excellent since the age of 17,but i got devorced and got taken for money i really did not have. so at the age of 30 i was staring at a the wrong end of quite a large sum,which grew and grew,moving on 4 years i re-married and also developed parkinsons disease which is not a problem as thats what lifes thrown at me,i work in france as its easier to get work i send money home to my wife every week and live with a friend rent free.i cant work in my home land of england because even though im 33 and fit to work, i have to declare i have parky,then its an insurance issue,so the debt follows me into my new life and house and wife and a charging order put on my mortgage which is in joint name,i offered to repay as much as i could,i explained my circumstances and to no avail. is there any way of getting it removed or reduced or anything?as my wife is worried sick we may loose our home.:rotfl:

    It won't be removed until the debt is satisfied. Are you paying towards it every month?

  • at the moment no, i have not actually read the letter my self,im going back home friday so i will understand whats going on more then,thanks for your time.could i loose my home and be forced to sell it?

    In theory yes, if you ignore it and do not pay anything towards the debt, HSBC can force you to sell, however, if you are paying towards the debt it's highly unlikely a judge would allow them to reposess.

    Is there any equity in your house? If there's no equity they won't reposess, it will just sit there until you sell the house.
