Deposit not taken 12 months passed can they still request payment?

I have just rec'd a letter from magnet stating that after an audit they have not taken my deposit of £3000 for a kitchen( this should have been charged to my credit card).
It was just over 12 months ago when we purchased the kitchen. the balance for the kitchen was paid by a flexi loan arranged by magnet. This is all paid for. I should have realised that my credit card had not been charged but I was doing the whole house up at the time.

Does anyone know if magnet are within their rights to still ask for this money after a year has passed when it was their oversight in not charging my card at the time. Had the money then, big surprise to get this letter after such a timescale!

  • They are 100% in the right and legally could just have passed the debit onto your card.The fact that they have written to you to means they are giving you time to make sure you have enough credit limit on the card or for you to make alternative ways of payment.
    In effect they have given you an interest free loan of £3000 now it is time for you to pay up.

    Eric's quite right. You owe the money - they are entitled to it.

    But you might as well make them work for it.
    If they haven't given full info ask for a statement showing the price and payments made and dates, the credit card which the payment should have taken from ...
    Say your accountant wants the info maybe.

    Don't suggest you don't owe the money but just want to tie up loose ends.

    I think you should pay the money hon, I would have noticed if a payment had not gone out on my card, certainly for an amount like £3,000.

    I'd have noticed too, but some people have more money than they have sense.

    I for one don't buy the didn't notice it hadn't gone part of the first post.

    Best you're going to get on this is trying to come to an arrangement with them to pay it off gradually. Legally you haven't got a leg to stand on and should think yourself lucky, as someone has said above, that they didn't just debit your account without warning.

    You entered your PIN number (or maybe a year ago signed something) authorising it, so get ready to hand over those £s.

    Just pay it. You know you owe it. You should have contacted them before when it didn't show up on your bill. I don't buy the didn;t notice it line either. You thought they'd forgotten. It's just tough you didn't put the money by
