Please Help Needed Urgently.. :)

I've been trying to sort out my finances and i spoke to N***est to get a loan to consolidate some priority debts. ( i offered final settlements for these debts). When i spoke to Natwest they said i've been accepted and are sending the details. THEN i had to chase N***est because the paperwork was taking long to arrive and by this point i missed a deadline to pay a final settlement which was agreed.

A couple of days later i was informed that the loan was declined which was very frustrating and upsetting because i've already made these final settlements! AND i was told by a member of staff that i was accepted! It was apparently due to my not declaring some info which i was never asked and my credit rating. I have made a formal compliant about this and how the situation was handled.

As result of this one of my debtors has decided to give me a CCJ. I had sent a pro rata payment letter and explained what happened with N***est but they still decided to go ahead with the CCJ. The now threatening that if i don't keep up with the pro rata payment a statutory bankruptcy demand, which i have no clue about.

I'd really appreciate from help and advise. I hope what i've written make sense :)

Is there any point in my contesting this CCJ or should i just leave it because i've already started the pro rata payment ball rolling which i believe is on your record for up to 6 years... WHAT should i do? is a CCJ that bad?? i'm confused.

    All loans are accepted in principle until you get the paperwork from the lender so you have no way forward there.
    Its very unusual for any company to accept a full and final settlement if your payments are up to date and if you are in any way behind then you get defaulted thus killing off any chance of a new loan. For this reason I don't think borrowing money to do a full and final on a loan you can't afford is possible.

    Without wanting to be unduly harsh, it looks to me like you are a serial debtor, switching from one loan to the next every time you have problems paying and then running up more debts alongside the new loan. This is doomed to fall apart at some point. You look to have reached that point. Indeed if you are looking at pro rata payments to creditors then you are moving in the right direction to paying off your debts, as opposed to moving them around.

    As requested already, please post you income, outgoings and details of all debts including APR's and minimum payments. There are lots of tips to cutting out spending and an overview will help you too.

    As for you complaint regarding your loan. Forget it. It will just cost you time and effort to get no where.

    I appreciate your response but i've already sorted stuff with CCCS so i'll be given them all my finance details.

    I also appreciate it was the wrong thing to do by getting a loan but i'm not a serial loan monger. I've only got one loan.

    this debtor is from an accident i had and i've got to pay for the damages which came to quite a bit.

    the question i wanted to know was:-

    How long do CCJ's stay on your name? what exactly does it mean?

    CCJ's are on your record for 6 years. You will not be able to get credit at good rates whilst it is on your record.

    I think it depends on the details of the CCJ - I had one on my record following a dispute over an electricity bill with a landlady who I shared a house with. SHe had clearly given her own readings for months before I moved in, then gave the real one afterwards, obviously thinking she was only a bit behind, then the bill was £400 for a quarter! I disputed it, but lost (still don't understand why except she was blonde with big boobs) and had to pay her the extra over and above the £90 I'd given her as a reasonable sum.

    BUT I was still able to get a mortgage for £56,000 when I was earning only £16,000, just a year later, so I think it might depend on other things too when it comes to getting credit.

    But yes, six years on your record.

  • Can someone please answer my question. My ccj was defaulted in 1999 and the court date was 2001. When is it removed, is it from the default date or the court date. Equifax told me the default date, then they told me the court date. If it is the court date then it is on my record for 8 years and not six as the default which was registered in 1999 would have affected me before the court date. :mad: :mad:
  • i think its from the date of the CCJ, as this is registered on CCJ register as well as your personal credit file so it would make sense that the courts listed it for 6 years
  • You mean the court date do you. Its a bit crap if that is the case as it will now affect me for eight years and not six

    That is the case - it is the CCJ that stays for six years, not the default, so logically it has to be from the court's date.

    I have to say, mine didn;t affect me at all as far as I could tell.
