Ccj Help I Dont Know What To Do

Hi
I today received a county court letter for a catalogue debt from years ago, which i had asked for a signed copy of the credit agreement and they could not supply one has i had never signed it, since then I was harassed from several companies and ignored them all, now i have this ccj letter and i do not know what to do
Please can someone help me and advise how i go about contesting this ccj as im terrified

    A few questions:
    1. How long ago did you incur the debt?
    2. Have you paid into this or acknowledged it in writing in the last 6 years?
    3. Do you have anything in writing telling you they cannot provide an agreement?

    If you can give me the answers to these then we'll what way forward we can try.

    debt occured 2 or 3 years ago with the original company, not the ones chasing it now
    2) i started paying when i first got the account, but then stopped when i lost my job, i havent paid for over 2 years
    3) the company the debt is from, never answered or acknowledged my letters when they were sent asking for copies of signed credit agreement so i have nothing from them, but i know they dont have one as i never signed one with them, i have heard nothing from them for 2 years then this county court letter appears in the post to me.

    should i contest the claim? and if so how
    your help is greatly appreciated

    Hi again CB,
    I would definitely contest the CCJ Claim. Your defence is that there is no legally executed agreement for this account. That means that a court cannot enforce it. Where is the CCJ paperwork from? Is it Northampton?

    I've just seen that you've posted onto another thread-CCJ Helllpppp! and looking at that I think you have all the info that you need.

    Don't forget that if they do still persue it then you can ask for the hearing to take place at a court near wher you live. Essential if the original CCJ is from Northampton.

    do i just put down my defence is no credit agreement?? i have typed a cpr request today to the claimant and i will post this monday, is there anything else i should put down for defence or just no credit agreement will do??

    If you look at that other thread I've noticed there is alovely but long letter that I suggest you copy and send with your relevant details entered. Take a look at my previous post that I edited.

    hi thanks for reply, on the other threat louise 111 has put up a long letter to sent to the court, do you know if that would be something i should use, or should i just type that my legal reason is they dont have a legally executed credit agreement?, i have copies the cpr request from the other post.
    also how do i ask that they move it to near me if they pursue the case?

    CB,
    On the CCJ paperwork use the defence form. Write that you have sent the CPR request to the claimant and ask for more time. There may be a box to tick on the defence form or another form for asking for more time. The paperwork sent through, if genuine, should be fairly straightforward. On the defence form request that the case be transferred to a court near to you. I believe you can specify which court, so if there's one in your town then mention it. As said before definitely get it moved away from Northampton as it is a 'bulk' county court. The creditors use it as it's almost semi-automated, usually finds in favour of the claimant and orders horrendous payments. Make sure that you send your CPR request by recorded or special delivery and keep the slip. Once the time limit is up then you'll be able to use that other letter that's all in legalise on the other thread. Gotta say thanks for posting as I could well need such a letter myself soon and wouldn't have seen it if not for you!

    IMHO if they don't have an agreement the fact that you're sending back a defence form combined with them receiving your CPR request should make them back off.
