wanna information on British Oversea rights

dont know where to post this and wherther you can help me but worth the try

my cousin was born in hong kong and has a British overseas passport. When China moved in the family moved to america. She still has a british overseas terriority passport. she wishes to move to UK to work in the fashion industry.

can she come here or does she have to apply for a work permit. Looking at the

website says she is free move around EU. What rights does she have if she wants to stay here permanent. Also if future if she marries an american citizen can he come over here and stay etc

    Full British Citizenship automatically passed to BOTCs in 2002, but in order to take up some of the rights of British citizenship your cousin would have to provide proof of her status as a British Citizen. Generally this would mean exchanging her BOTC passport and applying for a British Citizen's passport. Once she has this document, she would be free to travel without a visa to the UK and to live and work within the EU including the UK. She would not, however, be entitled to state benefits nor non-emergency healthcare until she has built up sufficient residency requirements.

    As for her spouse, he could apply to come to the UK on a spouse's visa, which is generally issued for one year. A month before the expiry of the visa, he could apply for right of residency. He would not have the same rights as a full British citizen (unless, of course, he chooses to apply for naturalisation later on).

    Your cousin would be best advised to check this information with the British Embassy though!
