You say that they have refused requests for F&F before - was this over the phone or in writing? Also, when was the last payment made on this and what % F&F figure were you offering?

I think if you are a few years into the statute barred period it may be better to try to get an agreement over the phone but make sure your number is withheld. Always wait for a letter confirming F&F before sending payment.

If anyone has had any experience with this - good or bad, we'd love to hear what happened. I just don't think you should be tempting fate (or giving your signature )

Thank you George...I tried a few weeks ago to get a F&F and I offered to pay £9500 (over the phone & number withheld), but they refused to reduced the amount outstanding (£12397). I was paying Capquest monthly until March 2008. That is why I decided to request CCA from them in the hope that I could put more pressure on them so that I could get a reduced F&F in case they don't produce the CCA on time
