I'm considering bankruptcy and need some help.....

    The Co-op are fine - in fact, they were surprised at the OR's actions. We have been approved for the new accounts but obviously have to wait for the account numbers, etc to come through and then change all the DDs, etc. A bit of a paper exercise really, but the OR was insistent.

    OK, so I've decided bankruptcy is my best option.

    If I go to a legal aid solicitor, I don't have to pay the 495 right?

    It would do you no good to go to a solicitor. They wouldn't be interested anyway.
    You will have to pay the £495 (minus the £150 court fee if your exempt) no matter what.

    Sorry to say no....if it was that easy the legal aid system would be in a worse state than its in now....could you imagine the number of people going through the door if they thought they could petition BR for free

    depends on your circumstances/imcome/in receipt of benefits etc you may be allowed a reduction in court fees meaning you sould only have to pay the OR fees of £345

    I would have thought that you would be pleased to hand over any winnings to help clear your debts? I know I would.
    Most people save for their fees by witholding payments to their creditors once they have decided to go BR.
    Don't forget this is going to have a knock-on effect with you-ie future credit/mortgage/certain jobs. Make sure you get really good advice before doing this and don't just see it as an 'easy' way of clearing your debts-if you read any of the BR diaries on here,including Merry and Scarletts,you will see that there is a lot to this and it's not an easy option.

    I am not being judgemental by the way-just want to make sure you get all the facts as you seem to have loads of basic q's at the moment.I am no way an expert and not BR myself.

    Obviously If I could, I would.

    I've heard I can write to my bank and ask them to write off the debt....

    Ooh! Also, I understand it would !!!!!! me up getting a mortgage, but what about if I wanted to get my own place just renting?
