Claiming Loss of Earnings?

OK, this is where it might get a little confussing,

I have a job (well kind off)

I went for an interview almost 4 weeks ago, and the same day of the interview I was offered the job - which I have accepted,

The manager has stated that he wants me to start ASAP but as they do everything as they shold they are still waiting for a reference to come back from my last employer,

I have found out the Manager from my last place of work is on long term sick but the request has been sent on to head of my old department (which is higher than my old boss, we are still waiting!!

I have chased this myself with my old employer by email as trying on the phone I have no joy whatsoever.

I would have been looking to get my first months pay in a week and a half as I would have been working,

I have been speaking to someone as they wanted to suggest another position elsewhere and after explaing this they suggested I claim loss of earnings against my last employer as it is these that are holding me up,

Does anybody know if this is actually possible?

All help would be appreciated!

Your previous employer has no obligations towards you, indeed they could just refuse to give a reference without any recourse. You have no right to make a claim against them!

Even if they do eventually provide it, you have no claim.

Seems like this person I was talking to was just trying to get on my side then - whilst trying to get me on board for the job he had! Nice.

    Cheers.
