Help I've got a CCJ!!!

I've just got a CCJ courtesy of Braemar Finance, saying Judgment for Claimant (acceptance) saying I have to pay the full amount and that I have made an offer of payment that the claimant has accepted.

When I filled in the form I said I could only pay a few pounds a month and filled inthe budget sheet and everything, there's absolutely no way I can pay £1400 just like that, otherwise I would have paid it off!!!!

What can I do? I'm really worried because I have a month to pay it and the judgment was 28 May (I only got the letter today) _pale_

    Hi,

    I am in the same situation as you!!

    I have contacted CCCS as advised by the wonderful forum here and CCCS have advised me to download a form from the courts website a N245 form which sadly you have to pay £35 for but it should stop the full amount payment.
    If you need advice just do a search on the net for CCCS and you can find their number and give them a call. They are brilliant and very understanding.

    Hope that helps - and you are not the only one!!

    I really can't afford £35 :confused:

    What was the point in filling all those forms in if they were just going to ignore them?

    Hi,

    I think the best thing is contact CCCS as they are so well advised on your type of situations and are keen to help you out.

    Please don't worry there is always a way out!! I know, it has been a roller coaster for us!!

    Hi skint - you have 16 days from the date of judgment to object - there is no fee if you are within this timescale.

    As it was an acceptance it should have included the amount you offered so it is possibly a typing error - phone the court tomorrow and check. x

    Thanks, I will do but the judgment was 28th May and I only got the letter today - that's hardly fair!!!

    OK now it gets scary - I rang the court who said despite what the letter had said, they had not accepted my offer and I was asked to pay the whole amount as they were going for a charging order on the property (It's not yet in negative equity but will be quite soon so good luck to them with that....)

    She then went to get the file and said it should have been a judgment by determination and I should write to them asking for that. It'll be heard in a local court and the judge will decide what I have to pay.

    Which sounds less traumatic!!!!

    Next question, is there a standard letter for this sort of thing, or what can I expect? :o
