Lloyds TSB - Please can anyone help me

Hi

I am asking if anyone can advise me how to go about sorting out a debt with Lloyds as they are not responding to any of my letters.

Heres the problem in a nutshell.... My partner has an overdraft and Loan with lloyds for approx £5000.00 previously each month a direct debit was taken out of his current account to pay off his loan, that was until he started having money problems and the finances were not available in the account to pay the monthly aggreement. (oh this started about a year ago)

So... he wrote to lloyds saying that he was having difficulties paying and would they consider consolidating both the loan and the overdraft and he would pay one amount towards the both and would they lower the monthly payment and lastly to cancel the direct debit from the current account

This letter was not replied to charges were constantly being applied to the overdraft increasing it by £60.00 a month

he then wrote again asking the same question in the previous letter but could they also stop any further charges as he had aked for the direct debit to be cancel and consider refunding any previous bank charges regarding this situation since his first letter.

Result..:T (so I thought) this letter was replied to but only advising that reclaiming bank charges was hold and they would let us know:mad: (what!!)

He then wrote yet again! asking the same question as the first letter, no satisfactory reply again but a letter offering a reduced amount to pay off the loan in full!!!!!

He has now written about ten letters to Llloyds and also eventually to the financial ombudsman but to be honest they are not that quick.

He has now received a letter from a debt collection agency acting on instructions on behalf of lloyds to collect the debt .

He just seems to be comming to a brick wall with lloyds now and there seems nothing he can do until they reply.

Can anyone out there help!!! i refuse to ring them because it is so costly and at least we have copies of the letters sent.

Does anyone also know if we might be able to now get this debt written off

Thankyou so much

I'm not sure you will be able to get the debt 'written off' - your partner did after all borrow the money and promise to repay it and it is not Lloyds fault he couldn't pay it back.

However whether he will get the charges back and whether they are excessive is another matter. I don't think there is anything you can do regarding the excessive charges apart from see what Martins latest advice is on charges (I think it might be put a claim in and wait and see).

It might help to know how much the loan is for, how many years it was taken out for, what the apr is and what the outstanding balance is.

I would suggest you post an SOA so we can see a true picture of your finances and see if there is any way to save you some money and get this loan /overdraft sorted for you.

If you don't fancy posting an SOA try one of the free debt counselling services like CCCS or CAB etc.

I don't know if people have another address you can write to to get a reply or a cheaper phone number to ring for Lloyds?

  • Hi

Thanks for that, forgot to mention lloyds alreadly have had an income and expense breakdown for him.

I Just need to somehow get a reply from them as they are ignoring all the letters.

Everyones advice I have had from cab and other places have said to send letters but it's no use if they will not reply.

Have you managed to come to an agreement with the debt collector to pay what your partner can afford?
Put in an official complaint if you haven't already done so to Lloyds.

Not sure what else to suggest really, sorry.

  • I wrote a long letter to the debt collector advising that I had been trying to contact lloyds and the situation as it stands and until I have a reply from lloyds they can leave us alone!!

I have written x2 offical complaints to lloyds re this and guess what... they haven't been responded to hence I contacted the Financial Ombudsman but they are very very slow.

Thanks anyway for trying to help.

If both the loan and overdraft have been sold or given to a DCA to chase, there's not much that can be done about the overdraft right now, but you can request a copy of the CCA for the loan.

When was the loan taken out (roughly)
After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91

    Dad Gift 6k ¦ Savings & Inv Tst: £2,500
    Loan 10k: £0 ¦ Dad 5.5k: £2,270 ¦ LTSB: £0 ¦ RBS: £0 ¦ Virgin £0 ¦ Egg £0

    Total Owed: £2,270 (+6k) 11/08/2011
  • Hi

it was about 3 year ago and the balance is £2200.00.

Is there any code of practice that you are aware of for complaints that Lloyds have to follow? and surely I think passing it to a collection agency is out of order when they have not responded to any of my letters.

I have had similar problems with Lloyds-TSB over the past year and went through their complaints procedure and the Financial Ombudsman Service and received apologies and two ex-gratia payments of £100 - and guess what their Collections Centre still ignore my (recorded delivery) letters, accuse me of not paying when I am etc so I have made yet another complaint to the Ombudsman.
Their Brighton Collections Centre is a chaotic joke - I have recently had more joy sending correspondence to their Customer Services Team, 125 Colmore Row, Birmingham, B1 2AB, fax 08703334533 who acknowledge and also refer on to Credit Operations Customer services, Queens rd Quadrant, Brighton, BN1 3XJ, fax 01273 743369.
