How to prove shared care

OH pays maintenance for his children. 1 of them stays over but his ex is denying it. We have written down the dates (as advised by CSA) when the child stayed over. Will the CSA take this as proof if she still denies it? Obviously we don't want to get the child involved but could it come to that?

Hard to say, but I would advise you to appeal if they don't accept it as you will get a better hearing at a tribunal.0

I know this thread was from June but I was looking for CSA advice today on here and came across this post, after dealing with the CSA for 9 years as my hubby is a NRP, we have had a difference every time we have been for re-assessment, both sets of parents do the calendar thing and each time our claim has been denied because the dates dont match and they take the PWC word for it. Its their word against ours and the PWC won.0

Not as daft as it sounds!! Maybe not the clocking on card, but i've seen a case where PWC/NRP both provided diarys with different sets of dates, and NRP provided a selection of photos of the QC's, dated, of holidays, his wedding, weekends away with family, as it was mainly the holiday periods PWC was disagreeing with!!
Its a very difficult one for the case officer, deciding which person, both strangers to the case officer, is telling the truth.
The child wouldn't be brought into it.0 -
An update - the caseworker believed us in the end and is sending out a new maintenance calculation and schedule. We have 'proof' in that the child is on the pc when they come here and every time they log on it is recorded. The photos are a good idea but they don't prove that the child stayed the night. And what would you tell the child as to why you were taking their picture with a daily paper? It's tricky!
It's a very difficult scenario - our caseworker said it was a nightmare. Once we and PWC get the letter informing them of shared care, he thinks she will appeal and go to tribunal. All for a fiver a week :rolleyes:
As for stopping contact, the eldest is 16 and only comes once a week now anyway. The youngest is 13 and definitely wouldn't let her mum stop her from coming!Sealed Pot Challenge #817 £50 banked0
