    Depends on what you were dismissed for and what is in your contract specifically in regards to what constitutes gross misconduct which is an instant dismissal.

    I assume you are referring to the Employment Act 1996 (as amended)?

    You need to give us more information. How did they not follow procedure?

    Did you appeal your dismissal?

    Not correct. Even in cases of gross misconduct, procedures must be followed.

    Have you been in touch with CAB or ACAS? What have they advised re the the non-following of procedure?

    first of all. 1.they never invited me in writing to the 1st meeting.
    2. i wasnt told i could have representation so it was me against 2
    managers.
    3. the notes they took were completely different to what i had
    said and they never gave me a chance to look over them,
    they sent me a printed copy of the minutes of the meeting.
    4. they suspended me when they dragged me from my desk
    without warning or written confirmation by 2 newish
    managers who never consulted PR/HR prior to suspention.


    many more but from what i have gatthered from independent legal advice i do have a case for unfair dismissal.

    I would agree with floss2, you need to take impartial advice on this. No offence, but I don't think that you understand the law in this area well enough to bring a case yourself.

    Sometimes a bit more information is needed to be sure that sound accurate advice is given......and the implication from your posts was that you were doing it yourself as you still haven't answered the questions about CAB or ACAS, so what else are we to assume?
