Payments received BEFORE BR - Advice for me please!?!

    Thanks loads for all your help.

    Unfortunately we already have the cheque and everything has been agreed so there's no going back - if only we'd known this a month ago, we could have refused to settle and it wouldn't have gone to court until December. Oh well.

    Does anybody know if it will be seen as preferential treatment if it's paid to the CSA? We have huge arrears (caused by their incompetence, not unwillingness to pay) and if we can't use the money to pay mum back, we really need it to reduce these a bit to prevent further action from being taken. I know child support arrears aren't included in BR but I don't know if that means we can pay them extra without it being an issue.

    But your OR may not be happy but i cant see what they might do about it to be honest:confused:

    Thats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all …………. :(

    My OH is wanting to become br but he does have a claim currently going through as we speak, we are unsure of when it will be paid or how much (at most £2300) so are we saying then, that any monies received as pay out AFTER the BR cannot be touched by the OR?

    Thanks blind-as-a-bat, will wait to see if anyone says differently but that might be the best way to salvage something from this situation.

    As you can see my OH has dived in here and kept her finger on the pulse due to my ever increasing workload at work!

    I just wanted to say thanks for the suggestions and advice here - we're going to discuss this a bit further before deciding how to proceed.

    I'll post up a new thread once we start to go BR and hopefully it'll be of use to others.

    Hi Danni,

    Looking into using the money to pay off some of the CSA debt at present - unfortunately the CSA seem to have made yet another error when updating my case so it's all in limbo until they get it sorted!

    As/when (If?) I manage to get sorted I'll post how we get on - sorry I can't help now!
  • Have you already cashed the cheque?

    don't know if i'm totally off the mark here, but if you cashed it in at one of those cheque places (I know they take a %), could you not then just give the money to your MIL and then it wouldn't show up on your bank account??

    Just a thought...
