Taped phonecalls are normal procedure but you can request an S.A.R. and Picture will provide the recordings as well as other details of your application.

Hmmm......I don't remember how the phone call went TBH. We were just so relieved to be accepted. Is there a template letter for how to request a SAR?

Maybe by last year they were getting wind of people reclaiming their PPI so sent out PPI brochures so there would be no come-back on them? We definitely have not got a separate certificate - I have all the original paperwork (except the forms - got photocopies of those obviously), incuding the notes I made during the phone call with their representative.

As we have not yet redeemed the loan, is it legal to pay them the outstanding amount LESS the PPI, or do we give them what they say we owe and wait for this whole thing to be sorted?

So they do have recordings of the original phone calls then....TBH I really can't remember what was said. I did make notes and still have them, but I'm pretty sure I was not told outright that the PPI was only for 5 years. All I remember was being told that if we hadn't claimed in the first 3 years, we would get money back in years 3, 4 and 5. That isn't the same at all is it?

Presumably you were sent the same bumph ie the brochure explaining how the PPI works. Has no-one come back to you and said "you were sent all the info and you still signed the forms. You can't come back now and say you didn't want it"?

I will be keeping my fingers crossed for a good result for both of us. When did you send the first letter to Picture about this?

    Hi Suzy,
My sister in law lodged the complaint against Picture back in March. They did say we sent you this and that, but her arguement is that she didnt realise the implication of the 5 years and the fact it doesnt fully cover both her and her husband, but only one of them. They said that the telephone recordings showed that her husband said he wanted the main cover to be for him but in fact they have covered her instead!they didnt have an answer and just said that was their final decision etc and rejected the complaint. We then sent off for the SAR saying they wanted all recordings, copies of documents etc and they havent replied.

Picture themselves are now in the mire as they dont have funds to continue offering loans. They fired their Senior Exec and half the staff in May so not sure now whats happening with them. We are continuing with the claim and will be sending to the FOS and if they dont send the SAR, also the Data Protection commissioner!
    Keep bombarding them!!

In that case I think I will request the SAR in any event just so we have it.
