Temp for 2 years - rights?

I have been a temp with the same company for over two years and been told I am no longer needed. The company are making loads of redundancies and because I am a temp, its easy to get rid of me.

Do I have any rights?

    Unfortunately not, that's the downside of being a temp. However, having worked for the same company for over two years will look much better on your CV than having worked at lots of different companies over the same amount of time, so that is in your favour.

    Are you employed directly by the company where you are providing your services or are you working through an agency which charges the company for your services?

    Have you been managed by the company or the agency if there is one? E.g. has there been a time when your work was not to the standard they wanted and the company went through a procedure with you like a disciplinary?

    I work through an agency and I have received no disciplinarys - I have been praised for the work I have done. I am the longest member of my team!

    You probably don't have any rights from the company you are placed in as you are not employed by them, but you may well have employment rights from the agency.

    Actually - in this situation it is often a benefit being a temp. The department will have to reduce headcount and temp staff often don't count as headcount.

    LV's questions refer to who would be deemed to be your employer -the client company or the agency. If you are "managed" by the company, and going through a client company disciplinary process is one of the tests, then you could argue that the client company is in fact, your employer. However, client companies tend to be more savvy about this nowadays so tend to be very careful and let the agency do all the disciplining etc. So ironically, if you had been disciplined by a manager then that would have been a good thing!

    Was your position a fixed term, or was it temporary ongoing? If the latter, then you may have a claim for redundancy against the agency. However, it would be in the agency's interests to find you another position, which you may not find attractive and leave anyway. (ie they can make it difficult for you to claim redundancy)
