Are you aware that if you have moved and deliberately hidden from your creditors then the debt is not statute barred? There is a clause that if the creditor can prove that you have not updated them with your new address then this is enough to exclude it.

Also how do you know they haven't applied and been granted a County Court Judgement in your absence. If you get a CCJ the debt is again not statute barred and it remains in force until you pay it off.

I work with victims of domestic violence who usually have a lot of debt caused by partners.etc. They always want to know whether they can hide from it. My answer is always what if you run from the debt and you carry on with life as normal and then 3 years down the line they find you just as you are settled and then you have to start paying which causes more misery.
Better to get it sorted sooner rather than later.

What if you meet another young lady and you are all settled and ready for a mortgage and all of a sudden these debts crop up? She isn't gonna be to happy and this may scupper your long term plans.

  • Thanks everybody- you have given me a lot to think about.

I am on the electoral register at my current address, my driving licence is registered to my current address, I am on the Council Tax bill, the utilities are in my name. So I am not entirely invisible.

I am not going to check my credit files - doing this would certainly require giving my previous addresses and that would undoubtedly create a link where just now there is a chance that the link doesn't exist.

You have helped me to decide what to do - and that is nothing. I'll stick with my current bank (which I am perfectly happy with) and I'll live without a credit card (which I have been for years, anyway).

The fact is that if any of these creditors do find me, then I will pay up. I have never disputed my liability, just the fact that I would be paying thousands of Pounds to have set up my ex in her new home. I have read on here people who have experienced real personal hardship and who are trying very hard to sort out their lives; this makes me even less proud to say that in this case I fall into the category of "can pay, won't pay" (until they find me). It doesn't make me feel good, but I'd feel even worse if I was paying back the money that ex spent.

(Just had a thought, that as far as the joint loan is concerned, there is as much chance of the creditor finding my ex as there is of them finding me, so if they are as tenacious as has been suggested, then maybe there will be some justice after all!)

I respect you for the decisions you’ve taken, that being said, if you really want rid of your ex, then maybe you should face your debts now.

In years to come, if any creditor / DCA does trace you, the ghost of your ex will keep re surfing.

    Just my opinion.

So what name is the council tax bill for the property in? What name are the water rates in? What name is the electricity in?

If your driving licence doesn't have the correct address on, that's a criminal offence. Not completing the electoral roll request that pops through the letter box is a criminal offence.

If you apply for a new bank account, it'll have your new address on and that'll go on your credit file as linked to your old one - . Likewise any credit card. YOU DO NOT GET A NEW CREDIT FILE. Chances are it already is if you got your car insurance on monthly payments.

How are you going to go on holiday to the USA when you're not going to pass the security checks because the dates and data for your residence are incorrect?

Mind you, you could simply carry on with the same fraudulent intent you have been for the past 2 1/2 years. Why not just go find your local Romanian gang and get a dodgy passport and driving licence in another name?

You seem to have forgotton the board guide of be nice to all again Conor

Off you go, read up, there's a good troll

OP ~ as others have said, the chances are you will be found. Even in his baiting of you Conor makes a good point re. utility bils.

Stuck in your throat or not I'm afraid your best bet is to bit ethe bullet, pay up and learn a harsh lesson in life / put it down to experience

Good luck and have a fab holiday ~ :D
That's not true at all. I've never been on the electoral register, I don't even know if I'm allowed, but I have a bank account with an overdraft and a credit card. I've never had any problem with getting a bank account.

What makes you think you wouldnt be allowed on the electrol register ~ if you are over 18 then you must be registered at the property for council tax purposes :confused:

If all you say above are in your name at your new address then you are already linked.

Hi, I get why you don't want to pay up, but won't leaving it mean the interest will build up? would you still be able to pay it? I know there is a limit on debts and how long your creditors have got to find you and demand payment, altohugh I don't know how long that is.

I just worry that in the end it will be worse. but that could be the beer talking!
    you know what Good luck

Popping in from another forum: are you sure the debt was not repaid by your ex? If you haven't been vigorously chased, perhaps that's because they found her first and she paid up. Not likely, true, but it would be quite funny if after all this hiding wasn't necessary.

I hadn't thought of that, kunekune. I tend to agree that it is highly unlikely, but maybe, just maybe, it is the case.

I think everyone who has contributed has been really helpful and supportive - I appreciate you all taking the time to help me. As this has been my first post, I have essentially been a complete stranger and yet you have spent your own time in trying to help me.

    Thank you!!

another thing to consider is if you had a joint account you and your ex will still be financially linked so any thing she is doing to her own credit record will also effect you.

As tigs says as the council tax people are aware you have moved and I presume where you moved from then you will already be linked to your old address. It really would be in your best interests to get your credit files and find out the exact position you are in.
