intrum justitia are w*nk*rs please help court advice

so inturm justitia had a hsbc account sent to them for collection,

only a small ammunt from a while ago 202.90

but i was already maxed out with payments from my other creditors i could only afford 5 pounds,

know i made a statemnt of means and the likes,and even got letter of debt advice line,

and sent in my offer of payment 3 times as heard nothing from them in about 6 weeks !!!,They were realy abusive when spoke to them on the phone so i decided to do all in wiriting,

i hear nothing for a few weeks not even a letter of intended legal action nothing,

then today a nice morning all details of bank accounts and a credit card form,i see a envelope i reconise the look off,

well what do you know a county court form for northampton :@

i rung gregory parker the solicitors like it said on the form and they dont want to know at all,

i have copys of letter sent to intrum,
and statement of means,

should i apply for the 28 days defence and then get this sent of to the courts with all the copys of letters, and wirte a letter of defence that i was willing to make payments,

weird thing is in the last letter i sent intrum a cheque never been cashed yet mmmmm

In short, yes. The judge will see that you have offered all you could.

And that's all Intrum will get. This is the same company with a £6 million 'black hole' in their accounts. Really efficient - not.

If the CCJ was issued "in default" i.e with out you returning a claim form or being present, then the best course of action is to ring the court and ask for a re-determination within the next 14 days.

in order to do this you must have a reasonable chance of defending the claim, and it may well be struck out.

if not you must be in position to settle it in full after the 28 days or it will be registered.

Think i'm missing something, have you received a County Court Judgement or a County Court Summons?

As the question was whether to file a defence, it sounds as though it is the summons and not a notice of CCJ. There is a clear defence to this action as an offer for payment was made and refused and as has been stated, the court will only order payment at the level offered unless it is clear that more is available. There may not be a defence to the action in that the debt is not disputed but the OP has not refused to pay so the issuing of court proceedings was unnecessary and there is no need to issue judgement for recovery.

Yeah it is a summons,

i am on holiday though tommorow so im gona file for the 28 days,

they never sent me a legal warning i dont know if they should,but they must have received at least one of my payment offers,

im going to file it online know

This is the company that ignored all my letters and kept sending me things saying I hadn't replied. When I called them they said they ignore correspondence (which they were taking up to 6 months to process antway) and only take notice of phone calls - they would never put a response from a phone call in writing (well they said they must have been lost in the post).
When I said they had an invalid debt and that the company owed me money they said that would be ilegal for the debt to be sold and how about me paying half the supposed debt as they could agree to right some off as they were so nice. If I didn't pay then they would visit - and no I couldn't arrange a time for a meeting it would be when I least expected it.
They eventually gave up and passed it back to the company but I never did get a written response from them. Cowboys if you ask me.
