    I am not an OR! Just a lowly examiner at the bottom of the hierachy! But i dont like they sound of the way your dad is being treated at all.

    My dad's pension is just the normal state pension, made up with benefits for basic living costs - income support etc. He gets housing benefit and council tax paid. The interviewer has looked at their I&E and decided that they have a surplus of around £300 which I guess is the attendance allowance and care component.

    As far as the car is concerned, the money that the interviewer reckons is now spare, my OH said that he could borrow our car and just declare that he needs to maintain that. That's fine with us but would be a struggle as we need it for work but the point is, I don't think we should all be put into that position.

    Choc - you may not be an OR but your advise is much appreciated ;)

    Point out to the examiner that if your dad no longer has a car he will need an allowance of several hundred per month for essential journeys as every journey will have to be by taxi.

    That should reduce his surplus but anyway, he does have a case for the car to be exempt if he is caring for a relative who needs the car.

    I wouldn't even offer it. If the OR thinks there is an alternative it may not look to good for him being able to keep his car.
