Not sure if I am posting this in the correct place so apologies if it's incorrect.
I have 3 default notices against my credit file for debts that are fully satisfied or settled.
One of the companies is Mint, I wrote to them asking for a copy of the original default notice because as far as I know I didn't receive this from them, I sent them a £1 cheque for their trouble. I received a letter from them today (with the cheque) saying that because the debt was fully repaid 8/5/08 I have no active agreement with them and they are under no obligation to provide me with this document. They also go on to say they is no legal requirement to provide me with the default notice. They then say that a default entry and a default notice are not the same and advise me to go to court to have inaccurate personal data rectified, blocked, erased or destroyed.
My default notice was registered 13/5/04, does anyone think that because of the date of registering the default they no longer have these documents and are just trying to stop me pursuing the matter or are they correct and they don't have to supply me with the original default?
Any advice would be very helpful as I'm desperately trying to get myself back on track.

I'm not sure about this. In most of the cases i have seen on the board, people just accept that a default notice will be on their file for 6 years. If they cannot prove that you owed the debt but put the default on your file... no idea what happens then.
You could do a subject access request to get all the information they hold on you under the data protection act. This would need to go back 6 years so i believe you should also get the credit agreement if there is one. Not too sure though. Might be worth doing another thread asking if you receive a copy of the CCA when you do a SAR. Not too sure how many people will have tried this, but it may generate a fair bit of interest - especially if you keep us appraised of what you are doing and the results/feedback you are getting.After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91
