Esporta cooling off period.

I have foolishly signed for a membership at sporta for £56 a month. Now i have realized that i made a mistake and it doesnt fit in my budget. While signing i thought that like any other contract made in Uk i should have a 14 day cooling off period. But having checked on the internet i found out that isn't the case.

So i am looking for advice on this matter. How can i cancel my membership and get out of the contract? i just signed yesterday and havnt used any facility yet in the club.

I hope someone can give me a proper advice before i contact the club.

    The 14 days only applies under distance selling, not to every other uk contract.

    i doubt there is much you can do, to be honest.

    Exactly what have you signed? It may be that they have sold you membership as some sort of credit agreement, which may be subject to a cooling-off period under the 1974 Consumer Credit Act.

    See if there is a 10 day cooling off period - ask at the gym. Some gyms do have them

    From the fact your paying monthly its reasonable to assume you signed a credit agreement. I'm betting you signed it at the premises of the gym in which case you don't have a cooling off period under the Consumer Credit unless it is specifically written into your contract, . Otherwise I fear your going to have to depend on the good nature of the manager.and hope he hasn't sent the paperwork of to head office

  • Hi, I used to work for Esporta and they do hard sell. I am afraid that you are now locked in a contract as long as everything is signed. They play upon the little fact that by signing on the premises they can totally wipe out any cooling off period. However, it is totally in the discretion of the club's general manager and Existing member's manager (usually called Member Services or Loyalty manager), so do appeal to them. At which branch did you sign up at?
