  • They received the cca request on the 27th and I posted it on the 23rd, so allowing for bank holiday they had until today and plus 2 Friday. Have they rushed this through or has it crossed paths. I didn't receive the 7 days warning that it will be taken to court

    Probably and it is not 7 days, after the 31st Aug 06 it went to 14 days regardless of which act it comes under. If it's a DCA then it will have been defaulted at some stage.

    There are things you have to do, post on Cag or Ccs forum because I am unsure.
    June 2005 = 48K of Debt:cry:
    Sept 2006 Started dmp = 56k of Debt (inc fees and charges) DFD April 2030:eek:
    May 2008 = <5k of Debt (CCA route -48K, paid off 3K) DFD April 2010
    Nov 2008 Lloyds found CCA for 14K loan:mad: New DFD Jan 2016

    Happy so far tomorrows another day:confused:
  • i phoned the NDL and was advised to phone the solicitor and explain I had were they aware that a cca had been asked for, the form may have crossed paths. Then maybe submit a defence explaining that a cca was asked for and give date, and hadn't been produced, if it produced it court it wouldn't look so good.

    Does anyone have experience of this?

    What I don't understand though, if according to the OFT a debt is unenforcable untill the CCA is produced, why have received court papers. I'm hoping it is an overlap and they will be withdrawn. :confused:
